Conditions and forms of incentives for staff
The Decree stipulates that policies to encourage dynamic and creative officials are applied when the proposed innovation meets the following conditions: It must be capable of removing bottlenecks and obstacles in mechanisms and policies not yet regulated in legal documents of the Government, the Prime Minister , ministries, ministerial-level agencies, and localities, and effectively solve the proposed problem. It must be for the common good, bring practical value and effectiveness, create positive changes, and contribute positively to the overall development of the country, locality, agency, or unit. It must stem from the urgent demands of reality; not affect national defense, security, or social order and safety; and not affect the development of other localities, agencies, or units. It must promote decentralization and delegation of power in state management, reform administrative procedures, and apply information technology.
The decree states that officials proposing innovation, individuals and organizations implementing such proposals, and agencies and heads of agencies employing such officials are encouraged through the following forms as prescribed by relevant laws:
Commendation and recognition before the entire agency or unit; rewards in accordance with the law on emulation and reward for proposals that are assessed as completed.
This serves as a basis for evaluation before classification, appointment, reappointment, planning, transfer, and rotation, prioritizing the placement and utilization of cadres with innovative thinking, creative approaches, and high efficiency.
Those who have been evaluated as having outstanding performance in public service are eligible for promotion to a higher civil servant rank; and may be considered for a salary increase 12 months ahead of schedule, as stipulated by law, for innovative and creative proposals that are deemed completed.
They will be encouraged and motivated through other forms in accordance with the regulations of the Party and the laws of the State.

Conditions and measures for protecting officials
At the same time, the Decree also stipulates that measures to protect dynamic and creative officials are applied in one of the following cases: Implementing innovative proposals that are assessed by the employing agency as completed according to regulations; Implementing innovative proposals that are not completed or only partially completed, causing damage, but are considered by the employing agency to have acted in accordance with the policy, with pure motives, and for the common good.
Regarding safeguards, the Decree stipulates that officials who propose innovations and creative ideas that are assessed by their employing agency as having been completed according to regulations will not be held liable under relevant laws. Officials who propose innovations and creative ideas but fail to complete or only partially complete the set objectives, but are considered by their employing agency to have acted in accordance with the policy, with pure motives, and for the common good, will be exempt from liability according to relevant laws.
The decree takes effect from September 29th.
