According to the circular, the monthly salary used as the basis for calculating overtime pay for teachers includes: Salary calculated according to salary coefficient (or according to job position), leadership position allowance (if any), salary allowances and reserve difference coefficient (if any).

The total number of extra teaching hours in a school year of each teacher calculated to pay for extra teaching hours shall not exceed 200 hours . In case the total number of extra teaching hours in a school year exceeds 200 hours due to the subject not being able to arrange enough teachers, the head of the educational institution must notify the competent authority in writing.

The total number of extra teaching hours during the school year for all teachers must not exceed the maximum that the educational institution is allowed to organize. If it exceeds due to a lack of teachers in certain subjects, the head of the educational institution must notify in writing the competent educational management agency.

Tasks for which remuneration or allowances have been paid will not be converted into teaching hours, nor will they be used to reduce the teaching hour norm for calculating overtime pay, unless otherwise provided by law.

The new circular stipulates that the total number of extra teaching hours in a school year for teachers is determined as follows:

Number of extra teaching hours of teachers/school year = (Total number of actual teaching hours/school year) - (Standard teaching hours/school year).

In there:

- Total number of actual teaching periods/school year includes: Actual number of teaching periods in the school year; converted teaching periods/school year according to regulations (if any); additional teaching periods/school year according to regulations (if any); reduced teaching periods/school year according to regulations (if any); number of periods counted towards the prescribed sufficient teaching period norm (if any).

For teachers assigned to teach on a secondment or inter-school basis, the actual number of teaching periods calculated per school year is the total actual number of teaching periods calculated in the school year at all educational institutions where the teacher participates in teaching;

- Standard teaching hours/school year of preschool teachers = (Standard number of teaching hours/day) x (Number of working days/week) x (Number of weeks teaching children/school year);

- The teaching hours/school year norms for teachers at other educational institutions are implemented according to current regulations on teachers' working regime;

- In case there are no regulations on the teaching hours/school year norms for teachers, the head of the facility shall stipulate them in writing after agreeing with the collective of teachers and management staff of the facility.

Based on the total maximum number of extra teaching hours in a school year that the educational institution is paid for and the number of extra teaching hours of each teacher, the head of the educational institution decides the number of extra teaching hours paid for each teacher, ensuring compliance with the prescribed principles.

Overtime pay

The salary for one teaching period of a teacher is determined as follows:

Salary for 1 extra teaching period = Salary for 1 teaching period x 150%.

Overtime salary/school year = Number of extra teaching hours/school year x Salary for 1 extra teaching hour.

Overtime wages of teachers (on the payroll list approved by competent authorities) when participating in practical instruction at workshops, stations, camps, laboratories in public educational institutions or on training ships will be implemented according to the provisions on overtime wages of labor law.

Paying overtime pay for teachers who have not worked for a full school year

Teachers who do not teach for a full school year are entitled to overtime pay corresponding to the actual working time. Specifically:

Number of extra teaching hours of teachers/school year = (Total number of teaching hours during actual working time) - (Teaching hour norm/actual working time).

In there:

Total number of teaching periods during actual working time includes: Number of teaching periods taught during actual working time; number of teaching periods converted during actual working time according to regulations (if any); number of teaching periods added during actual working time according to regulations (if any); number of teaching periods reduced during actual working time according to regulations (if any); number of teaching periods counted into the number of sufficient teaching periods during actual working time according to regulations (if any).

For teachers assigned to teach on secondment or inter-school basis, the number of teaching periods during actual working time is the total number of teaching periods during actual working time at all educational institutions where the teacher participates in teaching.

Salary for 1 extra teaching period, salary for extra teaching hours/school year for this type of teacher is as follows:

Salary for 1 extra teaching period = Salary for 1 teaching period x 150%.

Overtime salary/school year = Number of extra teaching hours/school year x Salary for 1 extra teaching hour.

In case of absence of 3 days or more in 1 week, that week will not be counted in the number of actual teaching weeks; in case of absence of less than 3 days in 1 week, that week will be counted in the number of actual teaching weeks.
