In the coming time, 5,700 Me Linh households will be allocated service land, ending the land dispute. This opens up hope for localities that are still stuck with service land.

Many localities still "owe" service land

2023 marks the 15th anniversary of Hanoi's administrative boundary expansion. Many provinces and cities such as the old Ha Tay and Vinh Phuc , after separating part of their boundaries and merging with Hanoi, have encountered many difficulties in the allocation of service land.

Ha Dong District has 15/17 wards benefiting from the service land policy. To facilitate land allocation to people, from 2008 to 2018, Ha Dong District developed a separate service land allocation project and allocated land to 20,000 households. The remaining households, due to disagreement with the project, filed a complaint, so in 2018, Ha Dong District had to stop to wait for the inspection conclusions of the Government Inspectorate and the city's departments.

Many localities are facing difficulties regarding the limits and subjects of service land allocation.

Talking to reporters of TN&MT Newspaper, Ms. Nguyen Thi Coi (Kien Hung Ward, Ha Dong District) said that according to the old Ha Tay service land policy, each household losing 650m2 of agricultural land would receive 10% of service land. In 2009, after the merger, Ha Dong District proposed to only hand over 7.7% of the area. The remaining 2.3% was reserved for building schools and roads. All households that agreed had handed over all of it.

“We have not been given service land to build a house, and the remaining agricultural land cannot be cultivated. The whole family has lost their livelihood for many years. Our wish is to soon be given land at a rate of 7% or whatever, we do not ask for more” - Mrs. Coi wishes.

Mr. Dang Tran Duc - Chairman of Kien Hung Ward People's Committee, Ha Dong District, Hanoi said that since 2018, the division of service land had to stop. The reason is that the inspection teams on service land work said that the previous service land division plan of Ha Tay City had some points that were not in accordance with the provisions of the law, so it had to stop and wait for instructions from higher levels.

The representative of Me Linh District People's Committee said: Implementing the direction of Hanoi City People's Committee, Me Linh District People's Committee advised the District Party Committee to issue a master plan to comprehensively lead and direct the allocation of service land. The District People's Committee has developed a plan to allocate service land to people whose agricultural land has been recovered in accordance with regulations. Currently, the district has arranged enough land to be ready to allocate to more than 5,700 households and individuals. The District People's Committee is urgently coordinating with functional units to review and implement the process of allocating service land, creating conditions for people whose agricultural land has been recovered to soon stabilize their lives.

Similarly, in Thanh Oai district, Mr. Nguyen Xuan Loi’s family (Mui village, Bich Hoa commune) said that in 2006, his family received a notice that 729 square meters of agricultural land was confiscated to build Thanh Oai Industrial Park. At that time, the commune announced that, in addition to compensation and crop support, people would be granted 10% service land according to regulations. However, to date, no household has received service land.

According to Nguyen Tien Ngoc Tu, Head of the Department of Natural Resources and Environment of Thanh Oai District, when clearing the site for the Thanh Oai Industrial Cluster project, the People's Committee of Ha Tay Province issued a Decision on land allocation with land use fees for production and service business premises. Therefore, to ensure the rights of people whose land was recovered, in 2008, the People's Committee of Thanh Oai District issued a document requesting the policy of land recovery and service land allocation to households in Bich Hoa Commune to be applied according to the old service land allocation mechanism. However, only households whose land was recovered by 30% or more were entitled to the service land allocation policy. Households whose land recovery rate was equal to or less than 30% of the agricultural land area in use were not entitled to this policy, so they continued to send petitions.

Waiting for special mechanism

Currently, in Hanoi, many districts are facing difficulties in the allocation of service land. Hanoi City has issued a report and proposal to seek opinions from the Government and ministries and branches to resolve this issue.

According to Chairman of Thanh Oai District People's Committee Bui Van Sang, based on the above reality, the district proposed that the Hanoi People's Committee allow the district to allocate service land to households whose land was recovered to implement the Thanh Oai Industrial Cluster project according to Decision No. 1098/2007/QD-UBND (calculated according to 10% of the recovered area, not based on the recovery rate having to be over 30% of the total area). Accordingly, the Hanoi People's Committee also reported to the Prime Minister to request a special mechanism, approving the Thanh Oai District People's Committee to allocate service land to households in Bich Hoa commune.

Ms. Vu Thi Ngoc Hien - Deputy Head of the Department of Natural Resources and Environment of Ha Dong District said that in practice, land use management shows that there are cases of service land that have not been granted certificates or donated, so when land is recovered, many large families live together, so the allocation of 55m2/original household is not fair. Specifically, households that have 500m2 of agricultural land recovered are also entitled to 50m2 of service land, while households that have 5,000m2 recovered are only entitled to 50m2. This is unfair. Ha Dong District has also made many proposals to Hanoi City, but this matter still has to wait for the Government's decision.
