BTO-This is one of the opinions discussed at Dien Hong hall by Deputy Head of the Provincial National Assembly Delegation Nguyen Huu Thong giving comments on the draft Law on Consumer Rights Protection (amended) this morning, May 26.
Appreciating the drafting agency and the reviewing agency for accepting the opinions of experts and National Assembly deputies at the 4th session and the Conference of specialized National Assembly deputies last April, delegate Nguyen Huu Thong commented on the provision on Notification when collecting and using consumer information in Article 17 of the draft Law. Accordingly, delegate Nguyen Huu Thong said that it is necessary to consider the provision in Clause 1 because it is not suitable for electronic transactions. When conducting commercial transactions on an online platform, consumer information is one of the mandatory contents to be able to conduct transactions, usually information about full name, address, phone number, bank card or account allowing payment... so that authorities can easily manage the use of consumer information by online shopping sites that is not in accordance with the notification.
On the other hand, when conducting e-commerce transactions, the necessary information must be filled in the parameters to carry out the transaction. In addition, the provisions of the draft law state that the notification must be clear and public in an appropriate form, the phrase "in an appropriate form" is also qualitative, making it difficult to ensure feasibility. Therefore, delegate Nguyen Huu Thong suggested that it should be considered and adjusted to reflect in the draft Law closely and in accordance with reality.
In Article 34, regarding compensation for damage caused by defective products and goods; delegate Thong said that, in recent times, this regulation has created favorable conditions for consumers to use products of increasingly higher quality. In many cases where products do not meet the prescribed quality, upon receiving reports from the people, the authorities promptly stepped in to inspect and work with businesses. From there, there were measures to handle and inform the results of the handling to consumers, businesses also resolved and supported consumers. However, there have been some cases where the inspection and verification of product quality took a long time.
In addition, the remedies of enterprises have not been guaranteed according to the provisions of the law, especially for high-value products such as cars, high-tech electronic devices, etc. Only when the press, the Consumer Protection Agency and relevant agencies intervened did enterprises fulfill their commitments to consumers. However, these cases are very rare and consumers have to spend a lot of time, money, and travel many times to get favorable results. Particularly for products with low value, it is even more difficult for consumers to request enterprises to guarantee the product or the cost of product warranty is higher than the price of the product. Therefore, delegate Thong proposed that the draft law add regulations binding organizations and individuals doing business with defective goods or defective products to compensate consumers within a certain period of time.
Speaking at the discussion session, Chairman of the Committee on Science, Technology and Environment Le Quang Huy thanked the National Assembly deputies for their enthusiastic, accurate, specific and comprehensive comments on the major contents of the draft law.
