New policy from October 1: Increase registration fees and license plates for cars and motorbikes

Four new administrative procedures in the field of vehicle inspection; Adjustment of registration fees, issuance of license plates for cars and motorbikes; and Regulations on cars subject to recall are new policies that will take effect from next October.

Economic- related policies such as adjusting registration fees and license plates for cars and motorbikes; cases of cars subject to recall; 4 administrative procedures in the field of vehicle inspection... will officially take effect from October 2023.

Cases of cars subject to recall

The Government issued Decree 60/2023/ND-CP dated August 16, 2023, regulating the inspection and certification of technical safety and environmental protection quality of imported automobiles and imported components according to international treaties to which Vietnam is a member. In particular, the Decree stipulates that automobiles subject to recall include:

- Cars recalled according to manufacturer's announcement;

Cars are recalled at the request of the inspection agency. The recall request of the inspection agency is made on the basis of specific evidence and verification results of information reflecting on the technical safety quality and environmental protection of imported cars.

- In case cars that have been put on the market have technical errors and need to be recalled, the importer must perform the following tasks:

Within no more than 5 working days from the date of receipt of the recall notice from the manufacturer or from the inspection agency, the importer must notify in writing the sales agents to request not to sell on the market the recalled cars that have not been repaired;

Within no more than 10 working days from the date of receipt of the recall notice from the manufacturer or from the inspection agency, the importer must send to the inspection agency a written report with the following contents: cause of the technical error; remedial measures; number of cars to be recalled; appropriate recall plan;

Actively implement and comply with the recall plan. At the same time, importers must publish information about the recall plan and the list of cars to be recalled on the importer's website and sales agents in a timely and complete manner.

The Decree also stipulates the responsibilities of the inspection agency:

Notify the importer in writing of receipt of the recall plan and any additional requirements for the recall program (if any).

Require importers to carry out recalls; post information about recalled cars on the website of the Inspection Agency; monitor and inspect the implementation of recalls by importers according to plan.

Temporarily suspend quality certification procedures for automobile importers who do not fulfill their responsibilities as prescribed.

The inspection agency will consider stopping the inspection and certification of technical safety and environmental protection quality for cars of the same manufacturer if the importer provides evidence that the manufacturer does not cooperate to implement the recall plan.

For cars subject to recall that have not been issued a Certificate by the Inspection Agency, the Inspection Agency shall notify the customs office where the import declaration is opened to allow the importer to temporarily release the goods so that the importer can carry out the repair of the recalled cars. After the importer provides a list of cars that have had their defects repaired according to the manufacturer's regulations, the Inspection Agency shall continue to carry out the inspection and certification procedures according to regulations.

Decree 60/2023/ND-CP takes effect from October 1, 2023, applicable to automobiles from August 1, 2025.

Administrative procedures in the field of registration

On September 8, 2023, the Ministry of Transport issued Decision 1137/QD-BGTVT announcing 4 newly issued administrative procedures in the field of vehicle inspection under the management scope of the Ministry of Transport, including:

- Issuance of Certificate of technical safety and environmental protection quality for imported motor vehicles.

- Issuance of Notice of exemption from technical safety and environmental protection quality inspection for imported components.

- Re-issuance of Certificate of technical safety and environmental protection quality for imported motor vehicles.

- Re-issuance of Notice of exemption from technical safety and environmental protection quality inspection for imported components.

Decision 1137/QD-BGTVT takes effect from October 1, 2023.

The Ministry of Finance issued Circular 60/2023/TT-BTC dated September 7, 2023 regulating the collection rates, collection, payment, exemption, and management of fees for registration and license plate issuance of road motor vehicles.

Circular adjusting the increase in the fee for the first issuance of a registration certificate with a vehicle license plate in Region I (including Hanoi and Ho Chi Minh City).

Specifically as follows:

- Cars (except passenger cars with 9 seats or less; trailers and semi-trailers registered separately): fee is 500,000 VND/time/car (old rate is from 150,000 - 500,000 VND/time/car).

- Passenger cars with 9 seats or less (including pick-up cars): 20 million VND/time/car.

- Separately registered trailers and semi-trailers: VND 200,000/time/vehicle (old rate from VND 100,000-200,000/time/vehicle).

- For motorbikes: worth up to 15 million VND: 1 million VND/time/vehicle (old level from 500,000 VND - 1 million VND/time/vehicle).

- Motorcycles worth over 15-40 million VND: 2 million VND/time/vehicle (old rate from 1-2 million VND/time/vehicle).

- Motorcycles worth over 40 million VND: 4 million VND/time/vehicle (old rate from 2-4 million VND/time/vehicle).

The Circular takes effect from October 22, 2023.

4 cases exempted from motor vehicle registration fees

Also according to Circular 60/2023/TT-BTC issued on September 7, 2023 by the Ministry of Finance on regulations on collection rates, collection, payment, exemption, and management of fees for registration and license plate issuance of road motor vehicles, there are 4 cases of exemption from motor vehicle registration fees including:

Firstly, diplomatic missions, consular agencies, representative agencies of international organizations belonging to the United Nations system.

Second, diplomatic officers, consular officers, technical and administrative staff of foreign diplomatic missions and consular offices, members of international organizations of the United Nations system and members of their families who are not Vietnamese citizens.

Third, other foreign organizations and individuals (representative agencies of intergovernmental international organizations outside the United Nations system, representative agencies of non-governmental organizations, delegations of international organizations, members of other agencies and organizations) that are not included in the above subjects, but are exempted from paying or do not have to pay fees for granting vehicle registration certificates and license plates according to international commitments and international treaties to which Vietnam is a member.

Fourth, three-wheeled motorbikes for the disabled.

The fee collection organization shall pay 100% of the collected fee amount to the state budget (central budget). The source of expenses for collecting fees for granting registration certificates and vehicle license plates shall be allocated by the state budget in the collection organization's estimate according to the state budget expenditure regime and norms as prescribed by law.

The Circular takes effect from October 22, 2023.
