This is one of the provisions of Decree 125, issued by the Government on October 5th, which regulates the conditions for investment and operation in the education sector.
Accordingly, the operating conditions for private specialized high schools are the same as those for regular high schools, and they must also have educational programs, teaching and learning materials; and a team of administrators, teachers, and staff who meet the standards and responsibilities stipulated for specialized schools.
Decree 125 also stipulates several new provisions related to the conditions for establishing and operating preschool and primary education institutions.
Accordingly, these conditions must be consistent with the provincial plan and relevant local plans to comply with the provisions of the Planning Law.
According to the Decree, preschool and general education institutions wishing to operate must ensure basic conditions regarding land, facilities, equipment, educational programs; and teaching staff and management personnel; while specific standards and requirements of a professional and technical nature will be implemented according to specialized documents in the field of education.
The decree also adds the following provision: "For inner-city areas of special-class cities, the land area for school construction may be replaced by the floor area of the building, and the floor area must not be less than the minimum average land area per child/student as prescribed."
According to the Ministry of Education and Training, new urban areas and densely populated areas are facing school overcrowding, while land available for building educational facilities is increasingly limited. Therefore, the addition of regulations aims to partially address these limitations in densely populated urban areas, especially Hanoi and Ho Chi Minh City.

The Ministry of Education and Training also stated that, to ensure the principle of equal treatment among investors, the Decree stipulates that the investment capital required for domestic preschool and general education institutions to operate is similar to the investment capital required for preschool and general education institutions with foreign investment.
Specifically, the investment capital required for private preschools and primary/secondary schools to operate is: “at least 30 million VND/child (excluding land use costs)...” for preschools and “at least 50 million VND/student (excluding land use costs)...” for primary/secondary schools. For private schools that do not build new facilities but only rent or use existing facilities to conduct educational activities, the investment must be at least 70% of the stipulated amount.
Specifying the capital requirements ensures that educational institutions have sufficient financial resources to organize educational activities as well as maintain and develop school operations; it is one of the important factors contributing to ensuring and improving the quality of preschool and general education; and it strengthens the role and responsibility of investors when operating in the education sector.
This Decree takes effect from November 20, 2024, replacing Government Decree No. 46/2017/ND-CP regulating investment and operation conditions in the education sector and Government Decree No. 135/2018/ND-CP amending and supplementing a number of articles of Decree No. 46.
