The Chairman of the Provincial People's Committee has the right to transfer and dismiss the Chairman and Vice Chairman of the Commune People's Committee.

Authorized by the Prime Minister, Minister of Home Affairs Pham Thi Thanh Tra signed the Government's submission on the draft Law on Organization of Local Government (amended) to the National Assembly.

The People's Committee of Xuan Lung commune (Lam Thao district, Phu Tho province) held a meeting with the Head of the residential area.

In the draft Law, the duties and powers of the Chairman of the Provincial People's Committee are adjusted in some contents to suit the conversion from a 3-level local government model (province, district, commune) to a 2-level model (province, commune).

The Government adjusts some tasks and powers of the Chairman of the District People's Committee (according to the current Law on Organization of Local Government) to the Chairman of the Provincial People's Committee, ensuring the smooth and effective implementation of tasks and powers of authorities at all levels when implementing the 2-level local government model.

Therefore, the number of tasks and powers of the Chairman of the Provincial People's Committee increases from 15 (according to the current Law on Organization of Local Government) to 20 (according to the Draft Law on Amendments).

Notably, the Chairman of the Provincial People's Committee is entitled to: "Approve the results of election, dismissal, removal and decide on transfer and dismissal of the Chairman and Vice Chairman of the People's Committee at the commune level; delegate the authority of the Chairman of the People's Committee at the commune level; decide on temporary suspension of the Vice Chairman of the People's Committee at his level, the Chairman of the People's Committee at the commune level; decide on appointment, transfer, temporary suspension, dismissal of the heads of specialized agencies, other administrative organizations under the People's Committee at his level, heads of public service units directly under the People's Committee at his level".

Lead and direct the work of the People's Committee; convene and chair meetings of the People's Committee.

Lead and direct the implementation of tasks of implementing the Constitution, laws, and documents of superior State agencies and of the People's Council and People's Committee at the same level; inspect and handle violations in the process of implementing the Constitution and laws at the local level.

Lead and be responsible for the operation of the State administrative apparatus at the local level, ensuring the unity and continuity of the administration; for implementing administrative reform, public service reform, and civil servants in the system of State administrative agencies at the local level; for developing science and technology, innovation and digital transformation; be responsible for promoting the application of information technology and digital transformation in the operations of local governments at their own level and at the commune level in handling administrative procedures and providing local public services in accordance with the provisions of law.

Lead, direct, urge and inspect the work of specialized agencies and other administrative organizations under the People's Committee at the same level, the People's Committee and the Chairman of the People's Committee at the commune level.

Direct and be responsible for organizing the implementation of local budget estimates; effectively manage and use finance, budget resources, public assets, and local infrastructure within the scope of management according to the provisions of law.

Direct and organize the implementation of socio-economic development tasks, development of sectors and fields, urban development in the locality; organize the implementation of State management in the locality in the fields of finance, investment, land, agriculture, resources, environment, trade, services, industry, urban areas, construction, transportation, education, health, judicial administration, judicial support, internal affairs, labor, information, culture, society, tourism, and local sports according to the provisions of law.

Direct and organize the implementation of tasks on foreign affairs activities, cooperation, and participation in international cooperation programs to promote economic, cultural, and social development in accordance with the provisions of law.

Directing and organizing the implementation of tasks related to ensuring national defense, security, order and social safety in the locality according to the provisions of law; performing tasks related to protecting the assets of agencies and organizations, protecting the life, freedom, honor, dignity, property, other legitimate rights and interests of citizens, ensuring human rights; preventing and combating crimes and other violations of the law in the locality according to the provisions of law.

Direct the implementation of policies on ethnic and religious issues in the locality; preserve and promote the cultural identity of ethnic minorities and religious followers in the locality according to the provisions of law.

Issue regulations on management of urban architecture and landscape in the locality; direct and take responsibility for managing local industrial parks and economic zones in accordance with the provisions of law.

Direct and be responsible for ensuring social security, implementing preferential policies for people with meritorious services and social protection beneficiaries; managing universities, colleges, intermediate schools, high schools, medical facilities, and social welfare facilities within the scope of management according to the provisions of law.

Direct and be responsible for the recruitment, use of civil servants, public employees, use and development of human resources, labor, employment, social insurance in the area according to the provisions of law and decentralization of superior State agencies; decide on appointment, dismissal, transfer, removal, commendation, and discipline of heads and deputy heads of specialized agencies, other administrative organizations, and public service units under the People's Committee at the same level.

Direct and promptly handle emergency situations related to natural disasters and epidemics in the locality; decide to apply other urgent measures prescribed by law in cases of real necessity for the national interest, prevention and control of natural disasters and epidemics, ensuring the lives and property of the people in the locality, then report to the competent authorities of the Party and the Prime Minister as soon as possible.

Directing the implementation of inspection, examination, citizen reception, complaint and denunciation settlement, prevention and combat of corruption, negativity and waste in the activities of the State administrative apparatus and in local socio-economic activities according to the provisions of law.

Issue, abolish, amend and supplement documents issued by oneself when deemed no longer suitable or illegal.

Suspend the implementation, abolish part or all of illegal documents of specialized agencies under the People's Committee at one level and illegal documents of the People's Committee and Chairman of the People's Committee at the commune level.

Suspend the implementation of illegal documents of the People's Council at the commune level, report to the People's Committee at the same level to propose the People's Council at the same level to abolish them.

Based on practical situations, strengthen the delegation of tasks and powers to the People's Committee and the Chairman of the People's Committee at the commune level to improve the management capacity of the commune level, increase efficiency, effectiveness and efficiency in State management, promote local socio-economic development, and manage and develop urban areas and special zones.

Perform assigned and delegated duties and powers and other duties and powers as prescribed by law.

The draft Law on Organization of Local Government (amended) is expected to be considered and approved by the National Assembly at the 9th Session (opening on May 5).
