Auto inspected maintenance facility

From today, auto warranty and maintenance facilities can apply for a license to provide motor vehicle inspection services, according to Decree 30/2023.

On June 8, the Government issued Decree 30/2023 amending and supplementing Decree 139/2018 on motor vehicle inspection services. The most important of which is to remove the content that the inspection unit must be legally and financially independent from the business unit of transporting, maintaining and repairing motor vehicles . Participating in the inspection service can be a public service unit, enterprise or cooperative.

According to the Ministry of Transport , this change aims to mobilize warranty, maintenance and transportation service establishments to participate in motor vehicle inspection, meeting the needs of people and businesses and promoting the application of science in vehicle inspection. Automobile maintenance and repair establishments wishing to be licensed for inspection must have sufficient conditions such as premises, equipment, human resources... according to the regulations on establishing inspection units.

The new decree also allows inspection personnel and facilities of the Ministry of Public Security and the Ministry of National Defense to participate in motor vehicle inspection if the inspection center system does not meet the needs of people and businesses.

To avoid the massive establishment of new centers, causing unhealthy competition as in the past, the Government has added regulations that the establishment of inspection units must be consistent with provincial planning, specialized planning and consistent with the number and density of vehicles registered in the area.

Decree 30 also allows the number of inspectors on each line to be 2, instead of 3, including at least one senior inspector as at present. According to the Vietnam Register, many equipment lines are currently not in use due to the lack of 3 inspectors. The new regulation will help maximize human resources to operate the inspection lines of the centers.

Regarding the conditions for vehicle inspectors, the decree maintains the current regulations - that is, vehicle inspectors must have a university degree in mechanical engineering, but allows for a reduction in internship time . Instead of vehicle inspectors having to have 12 months of inspection internship before taking the certification exam, the decree allows students who have worked for 12-24 months at an auto repair and maintenance facility to only need to intern for 6 months; those who have worked for more than 24 months need to intern for 3 months.

The new decree changes the direction of decentralizing the management of the inspection sector to localities. Enterprises applying for a license to operate an inspection center send it to the Department of Transport (not to the Vietnam Register as at present). The Department also decides to suspend or revoke the operation certificate of the inspection unit; inspect and evaluate the maintenance of conditions on facilities and human resources for inspection activities and notify the Vietnam Register for coordination in management.

Recently, some inspection centers have been competing unfairly and have committed many violations. To limit negativity in the inspection field, the Ministry of Transport has proposed amending Decree 139 to improve inspection quality, including the policy of granting inspection rights to help utilize the equipment of vehicle maintenance centers, increasing choices for people.

Faced with concerns that units that both maintain vehicles and provide vehicle inspection services will be "playing football and blowing the whistle at the same time", Mr. Nguyen To An, Deputy Director of the Vietnam Register, said that vehicle owners are completely free to choose where to inspect, maintain their vehicles and replace spare parts according to their needs, and the centers cannot force them.
