The Ministry of Transport is seeking opinions from ministries and sectors on the draft Decree regulating the facilities for motor vehicle registration and the facilities for inspecting emissions of motorbikes and mopeds. This is the basis for implementing the inspection of motorbike emissions according to the provisions of the Law on Road Traffic Order and Safety.

Accordingly, the Ministry of Transport proposed a number of regulations on conditions for opening emission testing facilities for motorbikes.

Motorcycle inspection facility must have a minimum area of 35m2

According to the drafting agency, there are currently only regulations on vehicle registration but no specific regulations on business conditions for motorbike and scooter emission inspection services and emission inspection procedures for two-wheeled vehicles.

Meanwhile, the Law on Road Traffic Order and Safety, effective from January 1, 2025, stipulates that emissions inspection must be carried out for two-wheeled vehicles.

To avoid legal gaps when the law comes into effect, the Ministry of Transport is consulting the Government to add regulations on business conditions for motorbike and scooter emission inspection services.

Accordingly, the draft decree stipulates that two-wheeled vehicle inspection facilities must meet three principles:

Granted certificate of eligibility for two-wheeled vehicle emission inspection activities.

Inspection activities must ensure independence, objectivity, transparency and compliance with legal regulations.

Mobile emission testing facilities must be arranged to ensure convenient and safe testing without causing traffic obstruction.

“Inspection facilities must have a minimum area of 35m2 and each inspection location must have a minimum area of 6m2. There must be an inspection area, a parking area, and an office area (not required for mobile inspection facilities). Emission inspection equipment must comply with regulations.

The staff of the emission inspection facility must have at least one inspector certified according to regulations," said the representative of the agency drafting the information.

In addition, the emission inspection facility must establish a management system to ensure the inspection and issuance of inspection stamps for motorbikes and scooters in accordance with regulations, procedures, standards, technical regulations and instructions related to the inspection of two-wheeled vehicle emissions.

Inspection units are allowed to collect service fees related to motorcycle and motorbike emission inspection activities, other fees (if any) and fulfill financial obligations in accordance with the provisions of law.

The inspection unit must publicize the inspection fee, the hotline number of the Vietnam Register, and manage the issuance of inspection stamps according to regulations... At the same time, the facilities must ensure normal inspection operation time of at least 8 hours/day and 5 days/week.

Inspection costs are not much

According to the leader of the Vietnam Register, the roadmap for motorbike emission inspection will be implemented according to the Law on Environmental Protection. The Ministry of Natural Resources and Environment will be the agency in charge of developing and submitting it to the Government for the Prime Minister to issue a decision.

At the same time, there will be a roadmap for implementing motorcycle emission inspection, in which relevant ministries and branches will advise the Government on the time of motorcycle emission inspection, applicable standards, implementation methods, specific subjects, etc.

The leader of the Vietnam Register said that currently, newly imported and assembled motorbikes are being controlled for emissions, only old vehicles on the road are not yet controlled.

In the future, the authorities can consider that new vehicles will not be inspected immediately, but will only be inspected after 2-3 years. For vehicles that have been used for many years, the authorities can calculate and study the appropriate time for inspection.

Regarding the emission testing fee, according to previous calculations by the Ministry of Transport, people may only have to pay 35,000 VND/time/year.

“The cost of emission testing will be insignificant and the emission testing is also very simple, taking only a few minutes, with a suitable route so it will not cause much disruption to people and society,” informed the leader of the Registration Department.

Article 42 of the Law on Road Traffic Order and Safety stipulates the technical safety and environmental protection of motor vehicles and specialized motorbikes participating in road traffic, clearly stating the inspection of motorbikes and mopeds (only performing emission inspection).
