Ngo Quyen District: Compulsory land repossession for May Hai Joint Stock Company at 72 Lach Tray due to lease expiration and no longer suitable for planning.
(Haiphong.gov.vn) – On the morning of October 31, the People's Committee of Ngo Quyen District organized the compulsory land recovery from Hai Phong Garment Company (now Hai Garment Joint Stock Company) to implement the City People's Committee's Decision on recovering the land at 72 Lach Tray due to the expiration of the lease and no longer being suitable for planning.
Implement the policy of the City People's Committee in the following documents: No. 6521/VP-DC2 dated September 12, 2024 on the enforcement of land recovery decisions; No. 269/TB-UBND dated October 24, 2024 on the conclusion of the Chairman of the City People's Committee at the meeting to listen to the report on the preparation for the enforcement of the decision to reclaim land from Hai Phong Garment Company (now May Hai Joint Stock Company) in Lach Tray Ward, Ngo Quyen District: From 09:00 on October 31, 2024, Ngo Quyen District People's Committee organized the enforcement of the decision to reclaim land from Hai Phong Garment Company (now May Hai Joint Stock Company), carried out the seizure, inventory of assets, fenced off the area to be enforced, directed the forces to grasp the situation, ensure security and safety in the area in accordance with the order and procedures prescribed by law, and no forces opposed to the person performing official duties must be handled.
After the enforcement date of October 31, 2024, May Hai Joint Stock Company must register with the People's Committee of Ngo Quyen District to dismantle the factory and move the Company's assets out of the enforcement area; complete the move before November 15, 2024. From November 15, 2024, if May Hai Joint Stock Company does not move the assets, it will be considered that the Company has refused to receive the Company's assets; the City People's Committee and the People's Committee of Ngo Quyen District are not responsible for the assets of May Hai Joint Stock Company after this date.
In the past time, the City People's Committee, Ngo Quyen District People's Committee and departments, branches and units have repeatedly organized propaganda and mobilized May Hai Joint Stock Company to comply with the handover of the site according to the issued Land Recovery Decision and Land Recovery Enforcement Decision. On October 30, 2024, the District People's Committee continued to organize dialogue, propaganda and mobilization before organizing enforcement according to the provisions of Clause 4, Article 89 of the 2024 Land Law; however, by 9:00 a.m. on the same day, May Hai Joint Stock Company did not attend the meeting.
Hai Phong Garment Company (now Hai Garment Joint Stock Company) was permitted by the City People's Committee to lease land at No. 72A (now No. 72) Lach Tray Street, Lach Tray Ward, Ngo Quyen District under Decision No. 1545/QD-UB dated September 8, 1997. The Company signed a land lease contract and was granted a Land Use Right Certificate No. G393762 dated September 6, 1997 for production and business purposes; form of land lease: The State leases land with annual payment for a land use term of 10 years (from September 8, 1997 to September 8, 2007).
In 2001, Hai Phong Garment Company was merged into Hai Phong Garment Company No. II according to Decision No. 2198/QD-UB dated September 19, 2001 of the City People's Committee.
On January 30, 2002, Hai Phong Garment Company handed over all facilities and assets (including the land at the above address) to Hai Phong Garment No. II.
In 2004, the City People's Committee issued Decisions No. 3325/QD-UB dated December 9, 2004, No. 264/QD-UB dated February 16, 2005 to equitize Hai Phong Garment Company No. II into Hai Phong Garment Joint Stock Company. Accordingly, Hai Garment Joint Stock Company is responsible for inheriting the rights and obligations of Hai Phong Garment Company No. II and carrying out land lease procedures in accordance with the provisions of the current Land Law.
In 2007, May Hai Joint Stock Company submitted a dossier to the Department of Natural Resources and Environment requesting the extension and reissuance of the Land Use Right Certificate at the above address. However, due to the incomplete dossier (there was no production and business project approved by the competent State agency), the Land Use Right Registration Office under the Department of Natural Resources and Environment issued Document No. 188/CV-VPĐKQSDĐ dated August 17, 2007 requesting the Company to provide additional dossiers, but the enterprise has not yet provided the dossier to the Department of Natural Resources and Environment.
Because the enterprise's land use term expired in 2007 and was not eligible for an extension by the State, the Department of Natural Resources and Environment prepared a dossier and submitted it to the City People's Committee to issue Decision No. 2592/QD-UBND dated August 10, 2022 to reclaim the above 6,462.5m2 of land according to the provisions of Point d, Clause 1, Article 65 of the 2013 Land Law.
On September 14, 2022, the Department of Natural Resources and Environment presided over the People's Committee of Ngo Quyen District, the People's Committee of Lach Tray Ward, the Center for Technical - Data, Information on Natural Resources and Environment under the Department of Natural Resources and Environment, the Center for Land Fund Development under the Department of Natural Resources and Environment and May Hai Joint Stock Company to organize the implementation of Decision No. 2592/QD-UBND dated August 10, 2022 of the City People's Committee; at the same time, request the Company to urgently move all assets out of the recovered land to hand over to the Land Fund Development Center under the Department of Natural Resources and Environment for management. However, May Hai Joint Stock Company has not yet complied with the handover of the site.
On December 5, 2023, the City People's Committee issued Official Dispatch No. 8348/UBND-DC2, assigning the People's Committee of Ngo Quyen District to: "Implement procedures and order to enforce the decision to reclaim land from May Hai Joint Stock Company according to regulations".
On December 22, 2023, the People's Committee of Ngo Quyen District issued Decision No. 3986/QD-UBND on compulsory land recovery from Hai Phong Garment Company (now Hai Garment Joint Stock Company).
