On the morning of May 11, continuing the 34th session, the National Assembly Standing Committee (NASC) gave opinions on the draft Resolution amending and supplementing Resolution No. 85 on taking a vote of confidence and voting for people holding positions elected or approved by the National Assembly and People's Councils.

Reporting at the meeting, Head of the Delegation Affairs Committee Nguyen Thi Thanh emphasized the need to issue a new Resolution to replace Resolution No. 85 in order to promptly institutionalize the policy on taking a vote of confidence and voting for confidence as defined in Party documents and laws; ensuring the principle of the Party's unified leadership of personnel work and personnel management.

At the same time, ensure the inheritance, constitutionality, legality and uniformity in documents on taking votes of confidence and voting for confidence; overcome limitations and difficulties in the practical implementation of Resolution No. 85, focusing on amending, supplementing and clarifying articles and clauses that are not suitable, clear and strict.

According to Ms. Thanh, Resolution No. 85 only stipulates the consequences for those who are given a vote of confidence and a vote of confidence, but does not clearly stipulate the implementation period, leading to arbitrariness and lack of uniformity and unity throughout the country. Therefore, the Delegation Working Committee has added regulations on time limit and timing in Article 10, Article 15 and Clause 4, Article 18 of the new draft Resolution.

Specifically, if a person who is voted for a vote of confidence is rated "low confidence" by more than half to less than two-thirds of the total number of National Assembly deputies and People's Council deputies, he/she must resign.

Within no more than 10 days from the date of announcement of the results of the vote of confidence, if the person does not resign, the National Assembly and the People's Council shall consider and decide on a vote of confidence at that session or the nearest session, but no more than 30 days from the date of announcement of the results of the vote of confidence.

If a person subject to a vote of confidence is rated "low confidence" by two-thirds or more of the total number of National Assembly deputies or People's Council deputies, the competent authority shall submit to the National Assembly or People's Council for dismissal at that session or the nearest session, but no later than 30 days from the date of announcement of the results of the vote of confidence.

Regarding the vote of confidence for the Chairman of the People's Committee of a district, town or ward where there is no People's Council, from the time of the proposal of the People's Council of the district or town, the Chairman of the People's Committee at the same level shall consider and decide within a maximum period of no more than 30 days.

The Draft Resolution also has a number of other new points such as: Adding regulations on the minimum number of National Assembly deputies and People's Council deputies attending the meeting to take a vote of confidence; regulations on publicizing the results of the vote of confidence on mass media.

The draft also amends and supplements cases where a vote of confidence is not taken for a person holding a position when there is a notice of resignation pending retirement, a notice of retirement or election or approval in the year of taking a vote of confidence (Point 6, Article 1) to ensure consistency and consistency with Regulation No. 96.

At the meeting, Ms. Nguyen Thi Thanh listened to comments from members of the Standing Committee of the National Assembly and reported on the reception and explanation of issues raised by delegates.

Concluding the discussion, Vice Chairman of the National Assembly Nguyen Khac Dinh stated that the Standing Committee of the National Assembly assigned the Delegation Work Committee to coordinate with agencies to continue completing the draft Resolution dossier to submit to the Standing Committee of the National Assembly in writing for consideration.

In case of needing to make many revisions, the National Assembly Chairman will consider and decide to arrange an additional meeting to complete the dossier so that the National Assembly Standing Committee can submit it to the National Assembly for consideration and decision according to the one-session process at the upcoming 5th Session.

In addition, it is necessary to clarify the basis for credit assessment to institutionalize Regulation No. 96 in accordance with the activities of the National Assembly and People's Councils (results of performing tasks assigned by the National Assembly and People's Councils...).

Regarding the consequences of the vote of confidence, Vice Chairman of the National Assembly Nguyen Khac Dinh suggested considering not specifying a specific implementation period, and designing two options for the National Assembly to discuss, but clearly stating the viewpoint of the Standing Committee of the National Assembly on which option to maintain and why .
