The above content is from the draft Circular regulating supplementary teaching and learning, published by the Ministry of Education and Training for public comment from August 22nd to October 22nd. This draft aims to replace Circular No. 17 of 2012 issued by the Ministry of Education and Training.

The draft outlines five principles for supplementary teaching and learning. These include the principle that supplementary teaching and learning should only be organized when students have a need for it, voluntarily choose to participate, and have parental consent. Teachers are prohibited from using any method to force students to attend supplementary classes.

The draft allows teachers to provide extra tutoring to students they are directly teaching at school. The condition is that teachers must report and compile a list of these students to the principal and commit to not using any form of coercion to force students to attend extra classes.

The draft also allows school principals to participate in extracurricular teaching activities outside of school hours, provided they report to and obtain the approval of the head of the Department of Education and Training (for lower secondary schools) or the director of the Department of Education and Training (for upper secondary schools).

The content of supplementary teaching and learning must contribute to consolidating and enhancing students' knowledge, skills, and character development ; it must not violate the law, and must not be prejudiced based on ethnicity, religion, occupation, gender, social status, or the customs and traditions of Vietnam.

The duration, time, and location of tutoring and supplementary classes should be appropriate to the psychological and physiological development of the age group, ensure the health of students, and comply with legal regulations on security, order, safety, and environmental hygiene in the area where the tutoring and supplementary classes are held.

The draft also stipulates that teachers must not cut down on the content of subjects in the school's educational plan to include in extra classes or tutoring; they must not teach content in advance compared to the curriculum distribution in the school's educational plan; and they must not use examples, questions, or exercises from extra classes or tutoring to test or evaluate students.

Teachers working at educational institutions that organize two teaching sessions per day are not allowed to provide extra tutoring or supplementary classes outside of school hours.

Regarding extracurricular tutoring within schools, the draft regulations stipulate that subject departments will hold meetings to reach a consensus on proposals to the school principal regarding extracurricular tutoring for subjects taught by those departments.

The total teaching time and organization of educational activities according to the school's educational plan, including extra classes and tutoring, shall not exceed 35 lessons/week for primary school, 42 lessons/week for lower secondary school, and 48 lessons/week for upper secondary school.

The school publicly announces the organization of extra classes and tutoring, including the objectives, content, duration, tuition fees, and a list of teachers for each subject and grade level, so that students who wish to attend extra classes can voluntarily register.

The draft requires organizations or individuals engaged in extracurricular tutoring activities outside of school to register their businesses in accordance with the law.

Tutoring centers must publicly disclose the subjects offered; the duration of tutoring for each subject and grade level; the location and time of tutoring; the list of tutors; and the tuition fees before enrolling students in tutoring classes.

Previously, Circular 17 of 2012 stipulated cases where tutoring was not allowed, such as: tutoring for students who already received two sessions of instruction per day from their school; tutoring for primary school students, except for training in arts, physical education, sports , and life skills.

Teachers who are receiving salaries from the public sector's payroll are not allowed to organize extra classes or tutoring outside of school, especially with students they are teaching in their regular classes.
