The above content is included in the draft Circular regulating extra teaching and learning, announced by the Ministry of Education and Training , and solicited opinions from August 22 to October 22. This draft aims to replace Circular No. 17 of 2012 of the Ministry of Education and Training.
The draft sets out five principles for extra teaching and learning. Extra teaching and learning can only be organized when students have a need for extra classes, voluntarily take them, and have their parents’ consent. Teachers are not allowed to use any form of coercion to force students to take extra classes.
The draft allows teachers to tutor students they are directly teaching at school. The condition is that teachers must report, make a list of those students and send it to the principal and commit not to use any form of coercion to force students to tutor.

The draft also allows principals to participate in extra teaching outside of school, requiring reporting and approval from the head of the Department of Education and Training (for middle school level) and the director of the Department of Education and Training (for high school level).
The content of extra teaching and learning must contribute to consolidating and improving knowledge, skills, and personalityeducation of students; must not be contrary to the provisions of law, and must not contain prejudices about ethnicity, religion, occupation, gender, social status, customs and traditions of Vietnam.
The duration, time and location of extra teaching and learning must be suitable for the psychology and physiology of each age group, ensure the health of students, and comply with legal regulations on security, order, safety and environmental sanitation in areas where extra teaching and learning classes are held.
The draft also stipulates that teachers must not reduce the content of the subject program in the school's education plan to include it in extra teaching and learning; must not teach content in advance compared to the distribution of the subject program in the school's education plan; and must not use examples, questions, and exercises that have been taught and learned in extra teaching and learning to test and evaluate students.
Teachers working at educational institutions that organize 2 sessions/day will not be allowed to teach or study extra.
Regarding extra teaching and learning in schools, the draft regulation requires that the professional team organize meetings to agree on proposals to the school head on extra teaching and learning for subjects undertaken by the professional team.
Total teaching time and organization of educational activities according to the school's educational plan and extra teaching and learning must not exceed 35 periods/week for primary school, not more than 42 periods/week for middle school, and not more than 48 periods/week for high school.
The school publicly announces the organization of extra teaching and learning, including objectives, content, duration, tuition fees, and a list of teachers teaching extra classes by subject and in each grade so that students who wish to take extra classes can voluntarily register for extra classes.
The draft requires organizations or individuals doing business in extra-curricular teaching and learning activities outside of school to register their business in accordance with the law.
The tutoring facility shall publicly disclose the subjects for which tutoring is organized; the duration of tutoring for each subject by grade level; the location and time for tutoring; the list of tutoring teachers and the tuition fees before enrolling students for tutoring classes.
Previously, Circular 17 of 2012 stipulated cases where extra teaching is not allowed, such as: No extra teaching for students whose schools have organized 2 sessions/day; no extra teaching for primary school students, except for cases of training in arts, sports , and life skills training.
Teachers who are receiving salaries from the salary fund of public service units are not allowed to organize extra teaching and learning outside of school, especially with students who are teaching regular courses.
