Proposed amendments to the Ordinance on Preferential Treatment for People Who Have Rendered Meritorious Service to the Revolution.

(Chinhphu.vn) - In Resolution No. 119/NQ-CP, the Government approved the proposal to add the draft Ordinance amending and supplementing the Ordinance on Preferential Treatment for People with Meritorious Contributions to the Revolution No. 02/2020/UBTVQH14 (the amending and supplementing Ordinance) to the 2026 legislative program of the Standing Committee of the National Assembly.

Add the draft Ordinance amending the Ordinance on Preferential Treatment for People Who Have Rendered Meritorious Service to the Revolution to the 2026 legislative program.

The government has assigned the Ministry of Interior the responsibility for the content of the proposed document, ensuring compliance with legal regulations.

The Minister of Home Affairs, acting under the authorization of the Prime Minister, signs the submission to the Standing Committee of the National Assembly on behalf of the Government proposing the addition of the draft Ordinance amending and supplementing the Ordinance to the 2026 legislative program of the Standing Committee of the National Assembly and is fully responsible for its content; proactively reports and explains to the Standing Committee of the National Assembly as prescribed.

The Ministry of Interior, in coordination with the Ministry of Justice and other ministries, ministerial-level agencies, and relevant agencies, shall implement the drafting of the Ordinance amending and supplementing the Standing Committee of the National Assembly's regulations in accordance with the Law on the Promulgation of Legal Normative Documents and other relevant legal provisions.

The above resolution shall take effect from May 5, 2026.

The Ministry of Interior stated that, upon review, the current Ordinance on Preferential Treatment for People with Meritorious Contributions to the Revolution contains 10 articles and clauses that are inconsistent with the organizational structure of the Government during the 16th National Assembly term; the functions, tasks, and powers of ministries and ministerial-level agencies; and the two-tiered local government model.

Furthermore, based on a review of the practical implementation of the Ordinance on Preferential Treatment for People with Meritorious Contributions to the Revolution, the process of organizing the implementation of policies recognizing martyrs, wounded soldiers, and those entitled to policies similar to wounded soldiers over the past period has revealed some regulations that still cause difficulties in application, especially related to determining criteria in cases of sacrifice or injury while performing duties in the fight against crime; bravely saving people and property of the State and the people; preventing and apprehending people who commit crimes; or cases where wounded soldiers die due to the recurrence of their wounds.

Some current regulations still use qualitative criteria such as "unable to provide timely treatment," "exceptionally brave," leading to difficulties in the process of determination and application in practice...

The amendments and additions to the Ordinance on Preferential Treatment for People Who Have Rendered Meritorious Service to the Revolution aim to align with the organizational structure of the new government term and the two-tiered local government model. Simultaneously, they aim to resolve obstacles in the process of considering and recognizing people who have rendered meritorious service, and to further improve policies and enhance the effectiveness of caring for the lives of this group.
