Restaurant encroaching on the sea , construction not in accordance with planning
With the goal of building Lan Chau Island (Cua Lo Town, Nghe An Province) into a unique sea tourism area, a high-class sea resort, in March 2014, this place was included in the planning project "Lan Chau - Song Ngu Eco-tourism Complex, Resort Villas, Sports , Entertainment" by Song Ngu Son Joint Stock Company as the investor.

The project was approved by the Provincial People's Committee with a total area of 14.8758 hectares (including 8.52 hectares of water surface), with a total investment capital of 495 billion VND. The main items include: Hotel and resort villa area (area of 1.24 hectares); Square and parking lot area (area of 0.7475 hectares); Mountain-top restaurant and sightseeing area (area of 0.98 hectares); Operations center area (area of 0.08 hectares); Bungalow area (area of 0.29 hectares); Marina area (area of 0.19 hectares); Beach area (area of 1.49 hectares) ...
After many adjustments to the schedule, the project is expected to be completed and put into operation in 2020. However, to date, the project has many unfinished items. Therefore, in July 2023, the People's Committee of Cua Lo Town decided to establish a comprehensive inspection team for the project "Lan Chau - Song Ngu Eco-tourism Complex, Resort Villas, Sports, Entertainment".
Although not in the planning, the investor built a 1-storey restaurant with an area of over 800m2.
Mr. Hoang Nang Hiep, Head of the Urban Management Department, said that the delegation inspected many contents, including: project implementation progress, construction according to the planning approved by competent authorities, land management, environmental sanitation and other related issues... Through the inspection, the People's Committee of Cua Lo Town discovered a series of violations in this project.
Specifically, the project “Lan Chau - Song Ngu Eco-tourism Complex, Resort Villas, Sports, Entertainment” had violations, problems, and construction works contrary to the planning approved by competent authorities. According to the conclusion, there were a total of 8 construction items that were put into use by the investor but were not included in the approved planning.
In particular, the northern sea embankment of the project has a length of 256.1m, in which the area encroached on the sea compared to the planning is 3071m2, the average width of encroached on the sea is about 17m; The road along the island, from the restaurant to the wharf, has also had new construction activities; The road surface is paved with cement concrete in some places, and some places are paved with bricks, and a number of railing systems are also built or installed; Apart from the two areas with Nghinh Phong pavilion, Tien tomb and the eastern rock beaches, the southern part of the island has not been affected by construction activities; The remaining area, most of which has been used as a restaurant and auxiliary works such as yards, roads, etc., has been concreted and changed in shape; the wild natural beauty is therefore being destroyed.
“The seawall and Lan Chau restaurant at the foot of the island are identified as two major violations of the project. Of which, the restaurant was solidly built and has been in operation for quite a long time. The seawall was not included in the planning but was concreted and built by the investor with many steps up and down from the hotel swimming pool area to Lan Chau restaurant at the foot of the island,” informed a representative of Cua Lo Town.
This restaurant has been built and operated for many years.
In addition, the project also has a number of illegal construction items that are not included in the planning, including: elevator construction and the path from the elevator to the restaurant on the island; security guard house behind the hotel; laundry, warehouse, toilet; seafood tank behind the restaurant at the foot of Lan Chau island; installation of corrugated iron roof behind the hotel...
The inspection team also determined that this project has 9 items in the planning but have not been invested in construction, including: service bar on the island; 11 resort bungalows; massage area, staff housing; resort villa area; square; seafood restaurant; garage; wastewater treatment plant; underground water tank.
Proposal to dismantle illegal construction items
After the conclusion of the inspection team, the People's Committee of Cua Lo Town held a meeting and requested the investor to dismantle, correct violations, and restore the original state of two major violating items: a 1-storey restaurant at the foot of Lan Chau Island, 843.6 square meters wide, and a 256 square meter long seawall in the North of the project, of which the encroached area is 3,071 square meters.
Because the project is on the list of projects behind schedule, Cua Lo town requires the investor to commit to the construction progress of items included in the planning but not yet built in order to propose an extension of the project completion time.
Regarding some other projects that violated regulations, in order to facilitate the production and business activities of the investor, Cua Lo town requested Song Ngu Son Company to adjust the planning accordingly.
“The town asked the investor to propose a plan to handle the illegal constructions, but up to now, the unit has not yet submitted a plan. The town's viewpoint is to request the company to organize the repair and dismantling of the items that risk destroying the landscape of Lan Chau Island mentioned above,” said the Head of the Urban Management Department.

Regarding the incident, to broaden public opinion, the reporter contacted Ms. Pham Thi Thanh Ha, General Director, Vice Chairman of the Board of Directors of Song Ngu Son Joint Stock Company via the public phone number of this unit. However, when knowing the content of the question, this leader refused to answer about the company's next plans after the conclusion of the inspection team of the People's Committee of Cua Lo Town.
According to the investigation, from November 2015 to October 2019, during the project implementation process, the investor was recorded 5 times by the Urban Order Management Team in coordination with the People's Committee of Nghi Thuy Ward, Cua Lo Town for violations such as illegal construction, violating the planning approved by competent authorities, according to the provisions of law...
For the above contents, all forms of handling must be applied such as fines and remedial measures in the direction of forcing the demolition of violating constructions. However, for some reason, in this project, the violations were only recorded as warnings.
This project is also on the list of slow-progressing projects in Cua Lo town.
Discussing this issue, Mr. Nguyen Quang Tieu, Vice Chairman of the People's Committee of Cua Lo Town, said that the town has assigned the Urban Order Management Team to advise on implementing procedures and handling violations of construction order.
“The People's Committee of Cua Lo Town will agree to let the investor carry out the procedures to request the Provincial People's Committee to allow an extension of the project completion time for items included in the planning but not yet implemented, after the investor organizes the implementation of remediation and complete removal of the above violations,” informed the Vice Chairman of the People's Committee of Cua Lo Town.
