
The project was approved for planning in 2017 and locally adjusted the detailed construction planning at a scale of 1/500 of the existing central area from E hill to Trang bridge, Dien Bien Phu city in Decision No. 3336/QD-UBND dated December 29, 2021. The project was invested in construction to form a multifunctional market and commercial service area, meeting business and trading needs, contributing to socio -economic development. At the same time, through the project, an area with beautiful architectural landscapes is created, associated with the preservation and restoration of historical relics and overcoming the encroachment of traffic routes and relic land for market holding, affecting the landscape, urban architecture, potentially causing insecurity and disorder.
The project is built on an area of over 18,083m2 with the scale of technical infrastructure construction: Construction of public works (market hall, parking lot...), urban trees, construction of urban roads and handover to local authorities for exploitation; construction of Muong Thanh market kiosks for organizations to operate, exploit and do business (lease). The land fund after investment and construction is handed over to local authorities for management of nearly 13,000m2 and the land fund for which investors pay land use fees and land rent for business and exploitation is over 5,000m2 . The total investment of the project is over 193 billion VND. The project implementation progress is in 2 years. In which, the first year prioritizes the construction of technical infrastructure and traffic. Special priority is given to the technical infrastructure and traffic of the market area (expected in the third quarter of 2022) to be able to build the market project to soon stabilize business, trade and the lives of people affected by the Project. In the fourth quarter of 2022, implement excavation, embankment, leveling and construction of the market project. In the second year, continue to invest and complete the market project; invest in the construction of green trees, squares and commercial and service projects to complete and put into operation. In particular, from the first quarter to the third quarter, invest in the construction of technical infrastructure, traffic and green trees, squares... From the fourth quarter of 2023, put the project into operation and exploitation.
In order for the investor to speed up the construction progress, the Provincial People's Committee has authorized the People's Committee of Dien Bien Phu City to decide on land recovery to implement the project. Accordingly, the City People's Committee organizes the implementation of work related to land recovery to ensure proper procedures and handle related problems. After completing the site clearance work, promptly complete the dossier and send it to the Department of Natural Resources and Environment for appraisal, and submit it to the Provincial People's Committee to allocate land to the investor to implement the project. The Department of Natural Resources and Environment is responsible for presiding over and coordinating with relevant agencies and units to guide, inspect and supervise the People's Committee of Dien Bien Phu City in the process of organizing the implementation of the land recovery decision, and reporting to the Provincial People's Committee according to regulations.
Although the roadmap is specifically set out for each quarter, after the groundbreaking ceremony and handover of the Project site (September 14, 2022), the construction investment period is almost over, but the project still faces many difficulties and obstacles, not on schedule. Up to now, the site clearance work has only reached 50%; the construction investment work has not been implemented yet. The estimated compensation, support and resettlement plan for 56 households with an area of over 9,715m2 with a value of 35.2 billion VND has just been publicly posted; 5 compensation, support and resettlement plans for 20 households and 4 organizations (Muong Thanh Ward Police, Forest Protection Department, Medical Station and Muong Thanh Ward People's Committee) have been prepared, submitted for appraisal and approved, with a total area of over 15,396m2 , with a value of 32.85 billion VND.
The reason for the delay is that some households built houses and ancillary works on land that did not meet the conditions for compensation for residential land, and there was no record of construction prevention from the People's Committee of Muong Thanh Ward. The land fund arranged for resettlement for eligible households was within the scope of the Muong Thanh A Urban Area project. Because previously the Muong Thanh Market and Trade Service project was part of the Muong Thanh A Urban Area project (currently separated into 2 projects). To carry out the site clearance work, the Provincial People's Committee recently issued a decision to revoke the old project and re-implement the legal basis procedures of the new project. In addition, the project is currently facing problems related to more than 2,000m2 that were previously compensated and handed over under the old project, but due to loose management, people re-occupied and used it.
To speed up the progress, the representative of the leader of NQT Quang Ninh Trading and Construction Joint Stock Company proposed that relevant units soon organize the implementation and accompany and coordinate with investors to remove difficulties within their scope of responsibility. When the site is cleared, the competent authorities will study and advise to allocate land in parts and grant construction permits in parts to investors to pay land rent, meet the conditions for construction of project items, ensure progress as well as current regulations of the state on project management and basic construction investment. At the same time, it is recommended that the province direct the People's Committee of Dien Bien Phu City to coordinate with the Department of Natural Resources and Environment, the Provincial Civil and Industrial Project Management Board and relevant agencies and units to promptly handle problems and problems related to compensation and site clearance.
Currently, the land calculation table of Muong Thanh Ward People's Committee is being publicly posted, so for households using land that has been recovered and assigned to the Provincial Civil and Industrial Works Project Management Board (investor of the project to build dams, embankments and build infrastructure for the Nam Rom riverside park); the City Land Management Center coordinates with the People's Committees of Muong Thanh and Him Lam wards, and the Provincial Civil and Industrial Works Project Management Board to notify households to receive all approved compensation and support money; carry out dismantling and moving assets and structures to return the land to the investor to implement the Project.
