Removing obstacles in the process of developing the country's digital technology industry
Presenting the Report on explanation, acceptance and revision of the draft Law on Digital Technology Industry, Chairman of the National Assembly's Committee on Science , Technology and Environment Le Quang Huy said that he had fully absorbed the opinions of the National Assembly deputies. Accordingly, after revision, the Draft Law on Digital Technology Industry consists of 6 chapters and 52 articles.

Regarding the content related to tax law, finance and investment incentives for a number of large-scale projects, the draft Law has been reviewed, transferring the content of regulations related to corporate income tax incentives and investment incentives in the draft Law on Digital Technology Industry to the regulations in the draft Law on Corporate Income Tax, the draft Law amending and supplementing 07 laws; the draft Law on Digital Technology Industry only provides references to ensure consistency of the legal system.
Regarding the provisions related to the Law on Personal Income Tax, the draft Law on Digital Technology Industry currently stipulates a policy of exempting personal income tax for high-quality digital technology industry human resources. These are policies aimed at attracting high-quality human resources and talents to institutionalize Resolution No. 57-NQ/TW. It is expected that the draft Law on Personal Income Tax (amended) will be submitted to the 15th National Assembly for consideration, comments and approval at the 10th Session.
Regarding the supplementary provisions on incentives for a number of special investment projects, Resolution No. 29-NQ/TW and Resolution No. 57-NQ/TW have identified the digital technology industry as a foundation industry, requiring special and outstanding incentive mechanisms in terms of tax, land, etc.; especially mechanisms to attract large-scale strategic digital technology projects such as semiconductors and artificial intelligence. Therefore, in order to institutionalize the Party's policy and incorporate the Government's opinions, on the basis of agreement with the Standing Committee of the Economic and Financial Committee, the draft Law on Digital Technology Industry has supplemented this provision and is stated in Clause 3, Article 29.
Regarding the controlled testing mechanism for digital technology products and services, to ensure the consistency of the provisions on the controlled testing mechanism in the draft Law on Science, Technology and Innovation and the draft Law on Digital Technology Industry, the Standing Committee of the National Assembly's Committee on Science, Technology and Environment has coordinated with the drafting agency of the two draft Laws, studied and absorbed the opinions of National Assembly deputies and revised the Law on Science, Technology and Innovation towards prescribing a framework for the controlled testing mechanism. On the basis of this provision, the Government will specify in detail the subjects, conditions, criteria, competence and other contents in accordance with management requirements. The Government has agreed on the acceptance and revision of the draft Law on Digital Technology Industry on the content of controlled testing of digital technology products and services to ensure consistency in the legal system.

Urgently complete regulations and guidelines on digital technology industry so that policies can soon come into life.
Commenting on the transitional provisions, Vice Chairman of the National Assembly Vu Hong Thanh said that in the context of innovative technology and digital transformation "developing like a storm", the regulation that the Government issues legal documents under its authority within 02 years is too long, and it is necessary to study to complete all documents, regulations and instructions sooner so that the policy can soon come into life, contributing to promoting double-digit growth in the next term.

National Assembly Chairman Tran Thanh Man requested the drafting agency and the agency reviewing the draft Law to continue reviewing and perfecting the regulations, ensuring consistency with other laws, avoiding overlap with current laws, and creating a favorable legal corridor for digital technology enterprises to develop. In addition, it is necessary to clarify incentive mechanisms for strategic industries such as semiconductors and artificial intelligence, while ensuring feasibility in implementing support policies.

Receiving the opinions of members of the National Assembly Standing Committee, Deputy Minister of Science and Technology Bui Hoang Phuong said that he will closely coordinate with the National Assembly's Committee on Science, Technology and Environment to review the contents and regulations to ensure no overlap with other laws, create a legal corridor for digital technology enterprises to develop, and ensure feasibility for individuals and businesses doing business in digital technology.
In order to strengthen policy communication to ensure widespread dissemination to the people, the Ministry of Science and Technology has also submitted to the Government a Project on strengthening the dissemination of the implementation of Resolution 57-NQ/TW with contents on science, technology and innovation. Immediately after the Law on Digital Technology Industry and the Law on Science, Technology and Innovation are passed by the National Assembly, the Ministry of Science and Technology will coordinate with ministries, branches and localities to promote dissemination activities according to the project approved by the Prime Minister.

Concluding the working session, on behalf of the National Assembly Standing Committee, Vice Chairman of the National Assembly Le Minh Hoan highly appreciated the initiative and positivity of the drafting agency and the agency in charge of reviewing the Draft Law.
The National Assembly Standing Committee agreed to accept and revise the Draft Law to ensure timely institutionalization of the Party's policies, clearly demonstrating the spirit of innovation in law-making, decentralization and delegation of power in the provisions of the Draft Law to both create development, promote production and business, economic growth, but also control risks and minimize administrative procedures.
Based on the discussion, the National Assembly Standing Committee also proposed that the Ministry of Science and Technology consider shortening the time limit for issuing documents implementing the Law to ensure that the Law, after being passed, will soon come into effect, meeting the strong development of science and technology, as well as helping the country to soon integrate into the new era./.
