Solving the copyright problem

The government and relevant ministries are actively taking action to address intellectual property infringement. This is having a positive effect.

Specifically, after Deputy Prime Minister Ho Quoc Dung signed Official Dispatch No. 38/CD-TTg on focusing on decisively implementing solutions to combat, prevent, and handle acts of intellectual property (IP) infringement, many websites and online forums specializing in providing pirated films, music, software, etc., have ceased operations and deleted infringing content. Of course, some websites and forums have not yet been completely resolved, so a stronger intervention from the authorities is needed.

Clearly, in today's era of integration and the knowledge economy , compliance with intellectual property rights (IPR) plays a crucial role and is one of the key conditions for global trade. Therefore, strictly addressing IPR infringement is essential. This needs to be implemented rigorously not only in a campaign but also maintained over the long term to create thorough and sustainable compliance.

However, besides addressing violations and raising awareness, we also need necessary policies to support people and businesses on this issue. In particular, applications on computers and mobile devices are gradually becoming an indispensable part of the lives and work of many people, especially office workers. Related to this, a reality exists: the cost of software and application licenses is not cheap compared to the average income of Vietnamese people. This is not to mention the high prices of advanced versions of many artificial intelligence (AI) applications and online services, while demand continues to increase. Indeed, cost has become a significant barrier to compliance with copyright laws among both individuals and businesses in Vietnam.

This is not to excuse wrongdoing, but it is clearly a problem that needs to be addressed. Some countries have tackled this issue through financial support programs for businesses and individuals. Another approach is to negotiate with technology companies to obtain preferential pricing policies for local citizens. On the other hand, many countries also implement programs to support the development and use of open-source and free software.

Each country develops appropriate programs based on its characteristics and budget. For Vietnam, in addition to referencing other countries to develop suitable programs, we can also consider supporting citizens through personal income tax. Currently, businesses are allowed to deduct the cost of using software and applications; we could consider applying this to individuals as well. Of course, if we apply this method, we need a specific framework outlining which software and applications are eligible, for example, focusing on popular software that the majority need. A similar but less complex approach is to consider software costs as a need for the majority, and then begin to include them as a factor when calculating personal income tax deductions.

Only by implementing a comprehensive set of fundamental measures can long-term compliance with intellectual property rights be ensured.
