Handing over more than 30,000m2 of land to Thanh Oai District People's Committee to implement the project

Accordingly, 30,444.7m2 of land in Tam Hung commune, Thanh Oai district (agricultural land of households, individuals and land managed by Tam Hung commune People's Committee; confirmed by Thanh Oai district People's Committee to have completed site clearance in Official Dispatch No. 331/BC-UBND dated July 2, 2024) was transferred to Thanh Oai district People's Committee to implement the project: Construction of technical infrastructure for auction of land use rights in Cung Trong area, Dai Dinh village, Tam Hung commune, Thanh Oai district according to Resolution No. 17/NQ - HDND dated October 18, 2023 of Thanh Oai district People's Council on approving the project investment policy; Decision No. 2225/QD -UBND dated March 15, 2024 of Thanh Oai district People's Committee on approving the project.

Location and boundaries of the land plot are limited by landmarks: from M1 to M13, M1 is determined in the Land Use Planning Map QH-02 at a scale of 1/500, prepared by Hatico Construction Investment Consulting Joint Stock Company, approved by Thanh Oai District People's Committee with Document No. 478/UBND-QLDT dated March 1, 2024.

In the total area of ​​30,444.7 m2 of land, there is 9,918.6 m2 of residential land (including land plots marked LK1, LK2, LK3, LK4) for management and organization of land use rights auctions according to regulations.

Form of land allocation: For Thanh Oai District People's Committee: land allocation without land use fee collection.

For the "auction winner" of land use rights: The State allocates land with land use fees collected. Land use term: According to the investment project implementation term as prescribed. Buyers of houses attached to land use rights are entitled to stable, long-term use; 4,974.4m2 of land (lot of land with symbol XH) to build social housing (implemented according to a separate project); 15,070.2m2 of land for trees, sidewalks and traffic; 481.5m2 of land within the red line; no construction, including fences.

Form of land use: Land allocation without land use fee collection. Thanh Oai District People's Committee is responsible for investing in the construction of technical infrastructure in sync with the general technical infrastructure of the area according to the approved planning. Long-term land use term. Land allocation method: land allocation without auction of land use rights, without bidding to select investors to implement projects using land.

The City People's Committee assigned the Thanh Oai District People's Committee (Thanh Oai District Land Fund Development Center) to contact the Department of Natural Resources and Environment to receive land handover on site. At the same time, organize the construction of technical infrastructure according to the approved investment project to ensure the overall planning, synchronous connection of technical infrastructure and regional infrastructure; be responsible for the preparation and approval of the Master Plan Drawing to ensure no interleaved land areas, economical and efficient use of land.

Prepare a plan for auctioning land use rights and submit it to the competent authority for approval and organize the auction of land use rights in accordance with the order and procedures prescribed by the 2024 Land Law, the 2016 Law on Property Auction, and decrees and circulars guiding their implementation.

Thanh Oai District People's Committee reviews the provisions in Article 7 of Decision No. 61/2024/QD-UBND dated September 27, 2024 of the City People's Committee before organizing the preparation of the Land Use Rights Auction Plan to ensure compliance with legal regulations, publicity, transparency and efficiency. Guide the auction winners to fulfill their financial obligations, register land use rights, prepare documents to apply for Construction Permits and Certificates of Land Use Rights, House Ownership Rights and other assets attached to land according to regulations. Use land for the correct purpose, boundary and area specified above; implement investment projects according to the provisions of law.

The Departments of Natural Resources and Environment, Finance, Construction, Planning - Architecture, Planning and Investment; Hanoi Tax Department guide the People's Committee of Thanh Oai district to implement specialized management contents according to regulations.

Hanoi Land Registration Office updates land use rights registration, performs change registration procedures, and corrects land changes in cadastral records according to regulations.
