Under what circumstances are teachers allowed to give extra lessons?

According to the regulations on supplementary teaching and learning currently implemented under Circular 17/2012 issued by the Ministry of Education and Training , supplementary teaching and learning is an additional teaching and learning activity for which fees are charged to learners, with content based on the general education curriculum but outside the educational plan of the general education curriculum issued by the Ministry of Education and Training.

Cases in which teachers are allowed to give extra lessons.

To ensure that supplementary tutoring activities are carried out effectively and for the intended purpose, the circular stipulates that supplementary tutoring is only permitted if students have a need for it, voluntarily choose to participate, and have the consent of their families; no form of coercion should be used to force students or their families to attend supplementary tutoring.

At the same time, teachers should not organize extra classes or tutoring sessions based on regular school classes; students in the same extra class or tutoring session must have equivalent academic abilities; when assigning students to extra classes or tutoring sessions, students' academic abilities must be taken into account.

Teachers are not allowed to provide extra tutoring to students who are taught two sessions per day by the school; they are not allowed to provide extra tutoring to primary school students, except in cases of: training in arts, physical education and sports, or life skills; higher education institutions, colleges, vocational schools and professional training schools are not allowed to organize extra tutoring or supplementary classes on content included in the general education curriculum.

For teachers in public schools, organizing extracurricular tutoring outside of school is prohibited, but they may participate in tutoring outside of school. Furthermore, public school teachers are not allowed to tutor students they teach in their regular classes without the permission of the head of the managing agency.

Similarly, teachers at private or international schools, if they do not teach students within their system, may find tutoring legal, provided it does not violate their employment contract.

Requirements for tutors

To participate in tutoring activities, tutors must meet the required training standards for each educational level as stipulated by the Education Law and be in good health. In addition, teachers must fulfill their civic duties and comply with all legal regulations; and complete their assigned tasks at their workplace.

Teachers participating in extracurricular tutoring activities must not be under disciplinary action, facing criminal prosecution, serving a prison sentence, undergoing non-custodial rehabilitation, under probation, subject to educational measures at the commune, ward, or town level, or admitted to a medical facility or educational institution; nor must they have been dismissed from their jobs.

Tutors must have the contents stipulated in Clauses 3 and 4 of this Article confirmed by the head of the managing agency or the Chairman of the People's Committee at the commune level (for tutors outside of school); and must be permitted by the head of the managing agency as stipulated in point b, Clause 4, Article 4 of this regulation (for teachers receiving salaries from the salary fund of a public non-profit organization).

Currently, the Ministry of Education and Training is developing and finalizing a draft of a new circular on regulations for supplementary teaching and learning. Once this draft is approved and promulgated, it will replace Circular No. 17/2012/TT-BGDĐT on supplementary teaching and learning that is currently in effect.
