Removing obstacles in licensing the import and management of products containing Formic Acid precursors

On August 31, the Government Office issued công văn (official document) No. 6254/VPCP-KGVX conveying the directive of Deputy Prime Minister Le Thanh Long regarding the licensing of import, export, and management of products containing the precursor Formic Acid.

Deputy Prime Minister Le Thanh Long directed the licensing of import and export, and the management of products containing the precursor chemical Formic Acid.

According to the official document, Deputy Prime Minister Le Thanh Long assigned the Ministry of Industry and Trade, within its functions, duties, and authority, to issue import and export licenses and implement management measures for products containing the precursor Formic Acid in accordance with the Law on Drug Prevention and Control, Government Decree No. 105/2021/ND-CP, Government Decree No. 57/2022/ND-CP, and other relevant legal documents.

The Ministry of Agriculture and Rural Development is urgently reviewing and promptly proposing to competent authorities appropriate management measures for drug precursors used in animal feed, aquatic feed, and other agricultural products.

Deputy Prime Minister Le Thanh Long instructed the Ministry of Public Security to take the lead and coordinate with the Ministry of Industry and Trade, the Ministry of Agriculture and Rural Development, and the Ministry of Finance to promptly review and propose to competent authorities amendments and additions to relevant legal documents to provide a basis for managing animal feed and aquatic feed products containing drug precursors, ensuring consistency, continuity, and compliance with legal regulations on drug and chemical prevention and control, animal husbandry, and aquaculture.

Recently, several businesses importing animal feed containing the precursor Formic Acid have encountered considerable difficulties. Many businesses import raw materials used in animal feed and aquatic feed containing Formic Acid, which is listed in the Category IVB of precursors issued with Decree 57/2022/ND-CP regulating the List of Narcotic Substances and Precursors. Customs authorities have faced obstacles in determining whether animal feed raw materials containing Formic Acid and mixtures containing precursors are subject to precursor management regulations under the Law on Prevention and Control of Narcotics.
