(Chinhphu.vn) - Mr. Trinh Viet Nam's wife (Ho Chi Minh City) has been paying social insurance contributions from September 2011 to the present. From November 2024 to May 2025, she took maternity leave and then returned to work. Currently, due to poor health, she wishes to resign and register for unemployment benefits.

Mr. Nam requested that the competent authorities provide guidance on the procedures and amount of benefits his wife is entitled to.

Regarding this matter, the Vietnam Social Security responded as follows:

Based on the provisions of Article 49 of the 2013 Employment Law, employees who are contributing to unemployment insurance are entitled to unemployment benefits when they meet the following conditions:

Termination of the employment contract is legal; unemployment insurance contributions have been paid for at least 12 months within the 24 months prior to the termination of the employment contract; an application for unemployment benefits has been submitted to the Employment Service Center within 3 months of the termination of the employment contract; and the applicant has not found employment after 15 days from the date of submitting the application for unemployment insurance benefits.

The monthly unemployment benefit is equal to 60% of the average monthly salary on which unemployment insurance contributions were paid during the six consecutive months prior to unemployment, with a maximum of five times the basic salary for employees subject to the salary regime regulated by the State, or five times the regional minimum wage for employees contributing to unemployment insurance under the salary regime determined by the employer at the time of termination of the employment contract.

Duration of benefits: 3 months if contributions have been made for 12 to 36 months, then for every additional 12 months of contributions, an additional month of unemployment benefits is granted (maximum duration of benefits is 12 months).

Required documents: application form for unemployment insurance benefits (according to the form provided by the Employment Service Center); termination notice; social insurance book with finalized contribution period; citizen identification card. Submit to the Employment Service Center where the worker wishes to receive benefits.

In accordance with the above regulations, if Mr. Nam's wife meets all the conditions, she is entitled to unemployment benefits as prescribed.
