The Department of Trade Defense ( Ministry of Industry and Trade ) said that a week ago, the US Department of Commerce (DOC) received a request for anti-dumping and anti-subsidy investigations into hardwood and decorative plywood imported from China, Indonesia and Vietnam.
The plaintiff is the Fair Trade Association for Hardwood Plywood in the United States. There are 130 Vietnamese enterprises accused of dumping and subsidization. The proposed investigation period is 2024; the proposed injury investigation period is 3 years (from 2022-2024).
According to data cited by the plaintiff from the US International Trade Commission (ITC), in the period 2022-2024, Vietnam exported approximately 401 million USD, 186 million USD and 244 million USD of the accused products to the US, respectively, ranking second among the three countries under investigation, after Indonesia.
The alleged anti-dumping margin on goods exported from Vietnam is about 112.33% to 133.72%, the lowest among the three investigated countries.
Similar to recent cases, because the United States considers Vietnam a non-market economy country, DOC will use third-country surrogate values to calculate dumping margins for Vietnam.
In this case, the petitioner proposed to use Indonesia as a surrogate country because it believes that Indonesia has a similar level of economic development to Vietnam and has a significant number of timber producers under investigation. The parties have 60 days to comment on the surrogate country before DOC issues its preliminary determinations in the case.
Regarding the subsidy allegation, the Plaintiff did not allege the magnitude of the subsidy. The Plaintiff alleged that Vietnamese hardwood and decorative plywood producers/exporters received 26 subsidy programs from the Government , causing or threatening to cause material injury to the US domestic industry.
To prepare for the incident, the Trade Defense Department recommends that businesses producing and exporting related products closely monitor the further developments of the incident. Proactively study and master the regulations, procedures, and processes of US anti-dumping and countervailing investigations and plan a suitable counterclaim strategy for the business (in case the DOC initiates an investigation). In addition, it is necessary to diversify export markets and products.
"Enterprises need to fully cooperate with the US Investigation Agency throughout the course of the case. Any act of non-cooperation or incomplete cooperation may result in the US Investigation Agency using available evidence to the disadvantage or applying the highest alleged anti-dumping and anti-subsidy tax rates to the enterprise" - the Trade Defense Department recommends.
