In his closing speech at the conference, National Assembly Chairman Vuong Dinh Hue said that from now until the end of the term, the workload of the National Assembly, the Government and agencies is very large and many new issues may arise that need to be handled. In such a context, the implementation of the laws and resolutions of the 15th National Assembly, especially the laws and resolutions just passed at the 5th Session, requires greater efforts, greater determination and closer and more effective coordination between agencies and organizations to put the National Assembly's decisions into practice, making practical contributions to the completion of socio -economic development goals and tasks, ensuring national defense, security, international integration, continuing to build and perfect institutions, the Socialist Republic of Vietnam's rule of law state, etc.
Law enforcement is a central and regular task.
The National Assembly Chairman emphasized the need to continue to thoroughly grasp the Party's guidelines and policies in the XIII Congress Documents, the Central Committee's resolutions and conclusions, especially Resolution 27 of the 6th Central Committee Conference, Session XIII, and Conclusion 19 of the Politburo . Continue to tighten discipline, enhance discipline and responsibility in the organization of law enforcement and resolutions of the National Assembly, especially the responsibility of heads of agencies, organizations and units. Strictly implement the conclusions and resolutions of the National Assembly, the National Assembly Standing Committee, and recommendations of National Assembly agencies through supervision to improve the effectiveness of law enforcement. Continue to identify law enforcement as a key and regular task of the Government, sectors, levels, agencies and organizations in the political system at both the central and local levels; ensure close connection between law making and law enforcement.
The Government shall further promote its role and responsibility in organizing the implementation of the Constitution, laws and resolutions of the National Assembly; focus on directing resolutely, ensuring resources and necessary conditions for law enforcement; review and promulgate under its authority or direct ministries and ministerial-level agencies in their respective fields to promptly promulgate plans to implement laws and resolutions passed by the National Assembly; promptly guide and have effective solutions to handle problems and shortcomings, ensuring that they meet practical requirements and comply with the provisions of laws and resolutions, especially in implementing new tasks and regulations identified in very important laws and resolutions such as: Law on Bidding; Law on Prices; Law on Electronic Transactions; Law on Cooperatives; Resolution on piloting a number of specific mechanisms and policies for the development of Ho Chi Minh City, etc.
Strengthen and innovate the dissemination and education of law in a focused and key direction, suitable for each subject, content, and locality, especially for ethnic minority and mountainous areas.
Overcoming the situation of debt and slow issuance of documents
The National Assembly Chairman stated that more drastic solutions are needed to overcome the backlog and slow issuance of detailed regulations and guidance on the implementation of laws and resolutions; at the same time, focusing on improving the quality of legal documents, ensuring the constitutionality, legality and consistency of documents issued by the Government, Prime Minister, Ministers, Heads of ministerial-level agencies and local authorities.
Focus efforts on completing the promulgation and ensuring the quality of 83 documents detailing the implementation of laws and legal resolutions of the 15th National Assembly, especially documents detailing laws and resolutions that have come into legal effect; by September 2023 at the latest, the development and promulgation of 2 decrees detailing the implementation of the Resolution on piloting a number of specific mechanisms and policies for the development of Ho Chi Minh City must be completed.
For the 8 laws that will take effect in 2024, the volume of detailed regulations expected to be issued is very large (68 documents). The National Assembly Chairman suggested that the Government have a specific plan, arrange reasonable priorities, invest resources to develop and issue complete and quality documents, ensuring that they are effective at the same time as the effective date of the law and resolution, especially for laws that take effect from January 1, 2024.
Along with that, seriously and urgently carry out the review of the system of legal documents as required in the Resolution of the 5th Session of the 15th National Assembly, promptly detect regulations that have arisen with problems, obstacles, contradictions, overlaps, and inadequacies during implementation to amend and supplement according to authority or propose amendments, supplements, and promulgation of new legal documents, and report to the National Assembly the review results at the 6th Session (October 2023). Improve the efficiency and quality, strengthen the inspection of legal documents in conjunction with monitoring, urging, and inspecting the responsibility of the implementation organization; perfect the legal basis for handling responsibilities and strictly and promptly handling organizations and individuals who commit violations in the process of drafting and promulgating legal documents.
Continue to promote decentralization and reasonable delegation of power along with strengthening inspection, supervision and monitoring; promptly and effectively overcome the situation of shirking, evasion and lack of responsibility among some cadres and civil servants, and strictly handle violations.
Strengthen administrative reform, especially administrative procedures, strictly control the issuance of circulars and guidance documents, do not allow the emergence of new procedures, "sub-licenses", standards and technical regulations that are inappropriate and lacking feasibility; stop using the form of administrative documents to set out procedures and requirements different from those prescribed by law.
Focus on completing the law and ordinance making program in 2023 and 2024 according to Resolution 89 of the National Assembly, in conjunction with continuing to thoroughly grasp and strictly implement the remaining legislative tasks of the entire term, solutions, and requirements for innovation, and improving the quality of law making activities according to Conclusion No. 19 of the Politburo and Plan 81 of the National Assembly Standing Committee.
Compliance with the Law on Promulgation of Legal Documents
Emphasizing that the law and ordinance development program for the last months of 2023 and 2024 is very large, with many projects having complicated contents, the National Assembly Chairman requested that agencies strictly comply with the provisions of the Law on Promulgation of Legal Documents in proposing and developing draft laws, ordinances, and draft resolutions; not proposing to add projects or drafts to the Law and Ordinance Development Program close to the National Assembly session, except in cases of real necessity and urgency, with conclusions from competent authorities.
Focus on time and resources for drafting, ensuring quality and consistency among relevant ministries and branches before submitting to the National Assembly and the National Assembly Standing Committee, thoroughly grasping the requirements in Resolution 27 of the Party on: "Issues that require practicality, are clear, have been proven correct by practice, and have high consensus, then resolutely implement; issues that are unclear, with many different opinions, continue to study, summarize practice, and pilot when authorized by competent authorities; policies that have been implemented but are not suitable, then study, adjust, and amend promptly".
In addition, it is necessary to urgently review and propose additional legislative tasks to promptly institutionalize the Party's policies and guidelines, continue to synchronously perfect the development institutions, build and perfect the Socialist rule of law State of Vietnam; focus on institutionalizing and effectively implementing the Party's policies on combating negativity in law-making work; and prevent the occurrence of "policy corruption", "group interests", and "local interests" in the development and promulgation of legal documents.
Continue to enhance the proactiveness and responsibility of the National Assembly Standing Committee and National Assembly agencies in monitoring, urging and supervising the Government, relevant agencies and organizations in implementing laws and resolutions of the National Assembly; focus on supervising the promulgation of detailed regulations, including the progress and quality of documents, considering this an important task that needs to be carried out regularly; proactively monitor and urge the implementation of conclusions and resolutions on supervision and questioning of the National Assembly, the National Assembly Standing Committee, and supervision recommendations of National Assembly agencies on the implementation of laws and resolutions in specific fields.
Strengthen coordination with the drafting agency to develop and implement the plan to issue detailed regulations to ensure that these documents are issued fully, promptly and effectively together with laws and resolutions.
Actively coordinate closely with relevant agencies in the process of drafting, reviewing and revising draft laws and resolutions; strictly control the implementation of the requirement that "draft detailed regulations must be prepared and submitted simultaneously with draft laws and ordinances".
Delegations of National Assembly deputies and National Assembly deputies continue to strengthen supervision of law enforcement and implementation of laws and resolutions of the National Assembly at the local level. The Vietnam Fatherland Front and its member organizations continue to strengthen and effectively implement supervision and social criticism activities; research and perfect mechanisms to further promote the people's supervisory role in the work of building, promulgating and implementing legal documents...
People's Councils and People's Committees at all levels, especially in localities that are piloting the implementation of resolutions of the National Assembly, continue to enhance their proactiveness, responsibility, creativity and flexibility in organizing the implementation of legal regulations at the local level; mobilize the participation of agencies, departments, and the support and companionship of people from all walks of life in the locality, closely coordinate with ministries and branches at the central level; propose a roadmap and appropriate implementation solutions, promptly issue projects and regulations, and seriously perform the tasks of local authorities in implementing the resolutions of the National Assembly; at the same time, promptly detect shortcomings in the implementation process right from the grassroots level to propose appropriate amendments, remove obstacles, and unblock institutional bottlenecks to promote development, promote the significance and practical effects of policies issued by the National Assembly.
Perfecting the law associated with improving the effectiveness and efficiency of law enforcement
The National Assembly Chairman said that the organization of the Conference on the implementation of laws and resolutions of the National Assembly is a new point in the activities of the 15th National Assembly to realize the policy of our Party and State on the work of building and enforcing laws. The Resolution of the Central Committee emphasized promoting the improvement of laws in conjunction with improving the effectiveness and efficiency of law enforcement. Innovating the law enforcement mechanism closely links law making with law enforcement to ensure that laws are implemented fairly, strictly, consistently, promptly, effectively and efficiently.
The National Assembly Chairman requested the Government, the Central Committee of the Vietnam Fatherland Front, the Supreme People's Court, the Supreme People's Procuracy, the State Audit, local authorities, relevant agencies and organizations to study and organize conferences or other appropriate forms to thoroughly understand and implement the specific contents of the laws and resolutions issued by the National Assembly under their responsibility or directly related to their agencies, organizations and localities. People's Councils at all levels should study and refer to experiences to organize practical activities to ensure full understanding, urge and seriously supervise the implementation of their resolutions.
The Secretary General of the National Assembly coordinates with the Standing Committee of the Law Committee and agencies to summarize and unify the content, organization methods, and ways of conducting the Conference to deploy laws and resolutions passed by the National Assembly at sessions, contributing to continuing to innovate the organization and operation of the National Assembly in a professional, modern, and effective direction according to the Party's Resolution; at the same time, synthesize recommendations and proposals at the Conference to report to the Standing Committee of the National Assembly.
