Theeducation sector, together with the police force and other authorities, have made great efforts in disseminating traffic safety laws to students and parents at schools in recent times. However, according to Thanh Nien Newspaper reporters, traffic safety violations by students are still common, typically driving motorbikes over 50 cm3 while underage.

Master Huynh Thanh Phu, Principal of Bui Thi Xuan High School (District 1, Ho Chi Minh City), said that there is currently a reality where high school students are not old enough but still use motorbikes over 50cc (cylinder capacity from 50 cm3 or more). This is a problem that gives schools a "headache" because the school's parking lot does not accept to keep the motorbikes, so students leave them in outside parking lots.

The principal of a high school in Thu Duc City (HCMC) also "miserably" said that at the beginning of the school year, parents signed a commitment not to let their children use vehicles that violate regulations, not to give them vehicles with cylinder capacity larger than their age, the school resolutely refused to keep students' motorbikes over 50 cm3 , but immediately, parking lots of private homes appeared right near the school.

In an interview with Thanh Nien Newspaper, the vice principal of a high school in Ho Chi Minh City said that many solutions have been implemented to make students obey traffic laws. However, many families still do not cooperate. Parents know that their children are not old enough to drive motorbikes over 50 cm3 but still give them motorbikes...

Lawyer Le Trung Phat, Director of Le Trung Phat Law Firm, Ho Chi Minh City Bar Association, said that according to Article 60 of the 2008 Road Traffic Law, people aged 16 and over are allowed to drive motorbikes with a cylinder capacity of less than 50 cm3 ; people aged 18 and over are allowed to drive two-wheeled motorbikes with a cylinder capacity of 50 cm3 or more.

According to Article 58, drivers participating in traffic must have a driver's license appropriate to the type of vehicle they are allowed to drive. Thus, students of any level of education who are under 18 years old are not allowed to drive motorbikes with a cylinder capacity of over 50 cm3 . Notably, according to lawyer Phat, if parents/vehicle owners hand over the vehicle to someone who is not qualified to drive, this act will be subject to administrative penalties.

Riding his parents' motorbike to school, the student said 'My family doesn't have the means…'

At noon on October 5, 2023, the Ben Thanh Traffic Police Team, under the Traffic Police Department of Ho Chi Minh City Police, set up a checkpoint at the intersection of Tran Hung Dao - Nguyen Thai Hoc, District 1, to control and handle traffic violations by students. NHH, a 16-year-old student of a high school, was driving a scooter with license plate 59E2-128... and was asked to stop for inspection. The traffic police determined that H. had violated traffic laws, the offense of "a person from 16 to under 18 years old driving a motorbike with a cylinder capacity of 50cc or more".

Next, another case was LTB riding a 120cc motorbike, also asked by the traffic police to stop and check at the checkpoint. B. was only 15 years old, a 10th grade student at ET High School. B. violated the law for people aged 14 to under 16 driving motorbikes, including electric motorbikes. For this violation, B. was given a warning, had his vehicle temporarily impounded, and the traffic police fined the vehicle owner from 1.4 to 2.8 million VND.

During the 1 hour of setting up the checkpoint, the traffic police discovered and fined 4 cases of high school students violating traffic laws, with the same violations as above. Most of the students, when asked about the reasons for the traffic violations, said that their houses were far away and their parents were busy with work, so they did not have time to take them to school. In addition, some students explained that they drove motorbikes over 50cc because "my family did not have the means, so I had to use my parents' motorbike".
