The 5th conference of full-time National Assembly deputies gave opinions on 8 draft laws.

On the morning of March 26, at the National Assembly House, under the chairmanship of National Assembly Chairman Vuong Dinh Hue, the National Assembly Standing Committee opened the 5th Conference of full-time National Assembly deputies.

Speaking at the opening of the Conference, National Assembly Chairman Vuong Dinh Hue stated that in implementing the Law on the Organization of the National Assembly and the Working Regulations of the National Assembly, since the beginning of the term, the National Assembly Standing Committee has paid great attention to regularly and periodically organizing Conferences of full-time National Assembly deputies. This is in accordance with the provisions of the Law on Promulgation of Legal Documents.

Since the beginning of the term, there have been 4 full-time National Assembly Deputies Conferences held. Deputies have contributed 323 opinions on 25 draft laws and 1 draft resolution.

Important issues were all brought to the Conference of full-time National Assembly deputies. Thus, since the beginning of the term, the National Assembly has voted to pass 32 draft laws, of which 25 draft laws followed the process of soliciting opinions from full-time National Assembly deputies; many valuable and very accurate opinions from full-time National Assembly deputies and some part-time National Assembly deputies have been received and refined.

Some difficult draft laws such as the Land Law (amended), the Law on Medical Examination and Treatment (amended), etc., thanks to the activities of the full-time National Assembly Deputies Conference, the quality has been improved, reaching consensus and receiving a very high vote of National Assembly deputies when considering and passing the draft laws.

The 5th conference of full-time National Assembly deputies is expected to take place over 2.5 days to discuss and give opinions on 8 draft laws, including the Law on the Capital (amended); the Law on the Organization of People's Courts (amended); the Law on Social Insurance (amended); the Law on Roads; the Law on Road Traffic Order and Safety; the Law on National Defense Industry, Security and Industrial Mobilization; the Law on Archives (amended); and the Law on amending and supplementing a number of articles of the Law on Property Auction.

These eight draft laws were reviewed and commented on by the National Assembly at the 6th Session with 969 opinions expressed in groups and halls and 30 opinions sent in writing by National Assembly deputies.

All these opinions have been fully synthesized, fully absorbed, revised and explained by the Standing Committee of the National Assembly to complete the draft laws. At the same time, the Standing Committee of the National Assembly has also directed the National Assembly Committees to closely coordinate with the agencies assigned to preside over the drafting of the draft laws.

The National Assembly Chairman said that since the beginning of the term, there has been close coordination, early, from a distance and companionship between the drafting agency and the reviewing agency from the beginning of the submission of the draft law until the National Assembly passed it.

The agencies have coordinated very closely with each other, organized many seminars, discussions, surveys, and consulted with experts, scientists , and relevant agencies and organizations to revise the draft laws; at the same time, the National Assembly Chairman and Vice Chairmen, together with leaders of the Government, the Supreme People's Court, and relevant agencies and organizations, the agency in charge of examination, and the agency in charge of drafting have also organized many more rounds and turns before submitting them to the National Assembly Standing Committee for comments.

As for the draft Law on the Capital (amended), the National Assembly Party Delegation worked with the Standing Committee of the Hanoi Party Committee twice; for the draft Law on the Organization of the Court (amended), the National Assembly Chairman, Vice Chairmen of the National Assembly and many National Assembly Committees worked with the Party Executive Committee of the Supreme People's Court twice...; closely followed policy groups, viewpoints, goals and guiding principles when drafting the draft law.

On that basis, in the regular sessions in February and March 2024, the National Assembly Standing Committee gave opinions on these 8 draft laws.

Thus, the progress of the draft laws submitted to the National Assembly for consideration and approval at the 7th Session was carried out earlier than in previous sessions. The conference of full-time National Assembly deputies was also held earlier. Therefore, there is still time for preparation work before the 7th Session takes place.

To make the discussion more effective, the National Assembly Chairman asked the delegates to consider whether the political basis and draft laws to date have thoroughly and seriously institutionalized the Party's policies on each issue or not?

The National Assembly Chairman noted the consideration of the constitutionality, legality, and consistency of the legal system in accordance with the conventions, agreements, and international conventions to which Vietnam is a member. Delegates reviewed these important contents to ensure the completeness and consistency of the legal system.

Along with that, the delegates reviewed the contents of the draft laws to date to see if they closely followed the major policies set out when drafting the laws. Which contents are new and are the additional issues different or more than the old policies? Have they fully complied with the regulations on lawmaking, especially the process of assessing the impact of new policies proposed for amendment or supplementation?

The National Assembly Chairman asked National Assembly deputies to give their opinions on major issues and issues on which there are still different opinions or different solutions; to review issues related to the application of laws and transitional provisions.

Among the 8 draft laws this time, there are draft laws with many special and outstanding policies and mechanisms, different from the provisions of current laws. Normally, the contents and provisions in the draft law are different from the draft law, other laws that need to be amended and supplemented can be implemented immediately in the draft law.

The draft Law on Capital City (amended) and the draft Law on National Defense Industry, Security and Industrial Mobilization have many outstanding specific policies. If they are amended right in these two bills and other related bills, it will be very complicated and there will not be enough time to process them. Therefore, the agency in charge of reviewing and drafting has proposed and the National Assembly Standing Committee has agreed to handle them in the application of the law.

The National Assembly Chairman emphasized that this is a very difficult and quite complicated task for some draft laws. Therefore, legislative techniques and issues of law application are very important to ensure that when promulgated, the law must be feasible and not overlap with other draft laws.

Stating that this conference is of great importance to the completion of the legislative tasks of the Session, the National Assembly Chairman hopes that delegates will contribute many dedicated, responsible and valuable opinions so that the National Assembly Standing Committee can continue to direct research, absorb and perfect the best quality draft laws to be submitted to the National Assembly for consideration and approval at the upcoming 7th Session.

The National Assembly Chairman emphasized that the process of building the above Law projects as well as building laws since the beginning of the term must continue to thoroughly grasp the principles of Resolution No. 27-NQ/TW dated November 9, 2022 of the 6th Conference of the 13th Party Central Committee on continuing to build and perfect the socialist rule-of-law State of Vietnam in the new period./.
