Online conference on the implementation of laws on land, housing, and real estate business.

On the afternoon of October 8th, Comrade Tran Hong Ha, Member of the Central Committee of the Communist Party of Vietnam and Deputy Prime Minister, chaired a nationwide online conference to implement the Land Law, the Housing Law, and the Real Estate Business Law. Attending the conference at the Thai Binh branch were: Comrade Nguyen Khac Than, Deputy Secretary of the Provincial Party Committee and Chairman of the Provincial People's Committee; Comrade Lai Van Hoan, Member of the Provincial Party Committee and Vice Chairman of the Provincial People's Committee; and leaders of several departments, agencies, and localities.

After two months of implementation, the new regulations of the Land Law and its implementing guidelines have initially shown effectiveness. These include decentralization and delegation of authority regarding land use conversion, land acquisition, land valuation, issuance of land use right certificates, land reclamation, etc., creating consensus among the majority of the people and the business community, and ensuring uniformity among agencies from the central to local levels. This has contributed to freeing up land resources for socio -economic development and accelerating the disbursement of public investment capital. To date, 50 out of 63 provinces and cities have issued some detailed implementing regulations for the Land Law; however, no locality has yet issued all the legal documents under its jurisdiction. During the implementation process in localities, several shortcomings still exist that need to be addressed promptly, such as: the progress in issuing detailed regulations for the implementation of the 2024 Land Law within the authority of provinces and centrally-governed cities; difficulties related to adjusting land price tables according to regulations; the preparation and public disclosure of planning for housing development areas have not been carried out systematically, openly, and transparently, creating conditions for land speculation. Localities lack initiative in creating land reserves for auction, leading to the long-term failure to meet the housing needs of the people.

For Thai Binh province, the Provincial People's Committee has issued 5 legal documents related to land matters, including: 1 document detailing some provisions of the Land Law and 4 documents regulating land prices and policies, compensation rates, support, and resettlement when the State recovers land. At the same time, 4 documents are being finalized and submitted to the judicial authorities for appraisal and reporting to the competent authority for promulgation, and 7 documents are being developed within the province's jurisdiction.

At the conference, ministries, departments, and localities focused on discussing and clarifying the causes and responsibilities for delays in issuing decisions within their authority; and the difficulties and obstacles that need to be overcome and resolved.

In his concluding remarks at the conference, Comrade Tran Hong Ha, Member of the Central Committee of the Party and Deputy Prime Minister , highly appreciated the efforts of ministries, sectors, localities, associations, and businesses... in working together, participating together, and reaching consensus in drafting decrees, decisions, and circulars to bring the laws into practical application.

With the goal of accelerating the completion of the promulgation of implementing documents for the Land Law, Housing Law, and Real Estate Business Law, meeting the urgent and necessary requirements of life to resolve difficulties and obstacles, the Deputy Prime Minister requested that Party committees and local authorities at all levels further strengthen leadership and guidance, focus resources, overcome difficulties, and uphold the responsibility of leaders to concentrate on building and perfecting documents within their authority. They should also promote training, dissemination, and widespread, regular, and continuous awareness campaigns at all levels, sectors, among the people, and businesses, ensuring a legal basis and creating consensus and unity in understanding and implementation. Furthermore, they should ensure the necessary conditions for effective implementation of the Land Law at the local level, such as organizational structure, human resources, funding, database development, and the issuance of economic and technical norms. Prepare the necessary resources, information infrastructure, and land database to develop land price tables in accordance with the 2024 Land Law. Strengthen inspections, audits, and enforcement actions against state management agencies and land users. In the immediate future, intensify inspections of the implementation of the 2024 Land Law in localities.
