Plan to implement the Data Law

Deputy Prime Minister Nguyen Hoa Binh has just signed Decision No. 75/QD-TTg dated January 11, 2025, of the Prime Minister promulgating the Plan for the implementation of the Data Law (the Plan).

The Data Law was passed by the 15th National Assembly at its 8th session on November 30, 2024, and came into effect on July 1, 2025.

The purpose of the Plan is to specifically define the work content, deadlines, completion progress, and responsibilities of relevant agencies and organizations in implementing the Law; to define the responsibilities and coordination mechanisms between ministries, ministerial-level agencies, government agencies, and People's Committees of provinces and centrally-administered cities in carrying out activities to implement the Law nationwide; and to raise awareness of the Law and the responsibilities of all levels, sectors, and localities in implementing the Law.

Disseminating, popularizing, and educating the public about data laws.

According to the Plan, in 2025 and subsequent years, the Ministry of Public Security, the Ministry of Justice, the Voice of Vietnam, Vietnam Television, the Vietnam News Agency, and other press, radio, and television agencies will organize the dissemination and education of laws on data.

Also in 2025 and subsequent years, the Ministry of Public Security will take the lead; ministries, ministerial-level agencies, government agencies, and People's Committees of provinces and centrally-administered cities will coordinate in organizing in-depth training and refresher courses on legal knowledge and professional skills in building, developing, protecting, managing, processing, and using data.

Compile documents to support the dissemination of the Law and other legal documents detailing and guiding its implementation; and training materials for professional development in the construction, development, protection, management, processing, and use of data by the Ministry of Public Security in 2025 and subsequent years.

Reviewing legal documents related to the Data Law.

The plan also stipulates that relevant legal documents under the assigned state management authority should be reviewed; and that within their authority, or by recommending to competent authorities, timely amendments, additions, replacements, repeals, or the issuance of new legal documents should be made to ensure compliance with the Law and related detailed implementing regulations and guidelines.

The Ministry of Public Security is reviewing legal documents related to the Law under its state management authority; ministries, ministerial-level agencies, and People's Committees of provinces and centrally-administered cities are reviewing legal documents related to the Law within their assigned scope, field, and geographical area of ​​state management.

Ministries, ministerial-level agencies, and People's Committees of provinces and centrally-administered cities shall submit the results of their review to the Ministry of Public Security before June 28, 2025. The Ministry of Public Security shall compile the review results and report to the Prime Minister before July 31, 2025.

Ensuring the necessary infrastructure, technical, and technological conditions for the implementation of the Law.

According to the Plan, the Ministry of Public Security and other ministries, ministerial-level agencies, government agencies, People's Committees of provinces and centrally-administered cities, and other relevant agencies and organizations shall ensure the necessary infrastructure, technical, and technological conditions for the implementation of the Law.

The Ministry of Public Security will take the lead; ministries, ministerial-level agencies, government agencies, People's Committees of provinces and centrally-administered cities, and other relevant agencies and organizations will focus on implementing synchronously and effectively the collection, updating, and synchronization of data into the national comprehensive database and the provision of technical infrastructure and information technology infrastructure of the National Data Center to state agencies.

The Ministry of Public Security is responsible for organizing the inspection of the implementation of the Law and the detailed regulations and guidelines for its implementation; other ministries, ministerial-level agencies, government agencies, People's Committees of provinces and centrally-administered cities, and other relevant agencies and organizations shall cooperate in the implementation.
