An effective "shield" against corruption.

The government has recently issued Decree No. 164/2026/ND-CP on controlling assets and income of officials and those in positions of power within agencies, organizations, and units. This is considered an important step in perfecting the legal framework for implementing the Law on Prevention and Combat of Corruption; creating an effective tool for detecting and preventing corruption effectively.

Corruption is an issue that has always been of particular concern to the people and public opinion. Using sophisticated methods, those involved in corruption have found every way to embezzle state assets, causing budget losses, degrading the investment environment, and hindering social development. More seriously, it reduces the effectiveness of the state apparatus and erodes public trust in officials – who are supposed to be servants of the people.

Declaring assets and income is considered one of the effective solutions for preventing corruption early and proactively. Therefore, establishing a sufficiently strict legal framework to control assets and income of those in positions of power and authority, along with strong sanctions for cases of dishonest asset declaration, is considered an effective shield against corruption.

The purpose of asset and income declaration is to enable competent agencies, organizations, and units to know the assets and income of those obligated to declare them, thereby ensuring transparency of their assets and income; serving the management of officials, civil servants, and public employees; and contributing to the prevention and deterrence of corruption. Based on this, Decree No. 164/2026/ND-CP clearly stipulates that assets and income subject to declaration are those of the person obligated to declare, their spouse, and minor children, including: land use rights; houses and construction works; other assets attached to land; gold, diamonds, platinum, and other precious metals and gemstones, each with a total value of VND 150 million or more. Stocks, bonds, capital contributions, and other securities with a total value of 150 million VND or more... The regulation requiring the declaration of assets belonging to spouses and minor children helps to limit the transfer of assets to relatives to conceal the origin of illicit assets. Notably, according to the decree, the total income between two declarations must also be declared. This regulation helps the supervisory agency compare legitimate income with the actual increase in assets. This is an important basis for detecting signs of illicit assets and clarifying the origin of assets if there is a large discrepancy.

To ensure deterrence, the decree also stipulates corresponding "sanctions" based on the severity of the violation. Based on the content, nature, extent, and consequences of the violation; the motive, purpose, cause, and circumstances of the violation; and aggravating and mitigating circumstances, the person obligated to declare assets will be subject to one of the following disciplinary measures: reprimand, warning, or dismissal. Accordingly, a reprimand will be applied to those who fail to submit their declaration after being reminded in writing a second time by the competent agency, organization, or unit; those who make dishonest declarations regarding assets and income totaling up to 10 billion VND; and those who provide dishonest explanations regarding the origin of additional assets and income totaling between 150 million VND and 10 billion VND.

Furthermore, individuals who make false declarations regarding assets and income requiring declaration, with a total value ranging from over 10 billion VND to 20 billion VND, or who provide false explanations of the origin of additional assets and income with a total value ranging from over 10 billion VND to 20 billion VND, will be subject to a warning. For cases of false declarations regarding assets and income requiring declaration with a total value exceeding 20 billion VND, or providing false explanations of the origin of additional assets and income with a total value exceeding 20 billion VND, the penalty will be dismissal from office. These strict penalties will contribute to rigorous enforcement and serve as a deterrent for those required to declare assets and income. A comprehensive legal framework is necessary, but to effectively combat corruption early and proactively through asset and income declarations, the most important thing remains the serious, coordinated, and substantive implementation through a mechanism for checking and monitoring its execution.

Combating corruption is not just about strictly punishing wrongdoing when it occurs, but more importantly, about prevention from an early stage and from afar. Strictly controlling the assets and income of those in positions of power and authority is one of the most effective "shields" to prevent corruption, strengthen the people's trust in the state apparatus, and gradually build a disciplined and honest team of officials and civil servants.
