Sea village in the "vortex" of land - Part 3: When will the "dream" come true?

(QBĐT) - On the day the FLC Quang Binh resort complex project (FLC Quang Binh project) was launched, many people called it a "dream" project. However, this project is currently being sued by many people to reclaim their deposits.

Project of "dreams"

For a long time, the subconscious of many people has been haunted by the harshness of nature and the difficulties of the people in the coastal areas of Quang Ninh and Le Thuy districts. Perhaps, because of this obsession, for a long time, many promises, plans and even projects to "awaken" the sand here have been "missed".

Then in 2014-2015, after many investment promotion conferences of the province, many large corporations likened to "eagles" chose the white sand strip here to "build nests", fanning the "flames" of hope.

The most notable is the FLC Quang Binh project of FLC Group. The project was started in 2016, with a total investment of up to 20,000 billion VND. The project is planned into 3 functional zones, including: Sea Horse, Sea Pearl and Sea Star, with a series of items, such as: 6-star hotel and villa area, shophouse, mini hotel, film studio; golf course complex, international conference center, coastal entertainment area... with a system of modern, international-class utilities.

People in Hai Ninh commune are waiting and hoping that the FLC project will continue to be implemented again.

The project aims to create a high-end resort, sports , commercial and entertainment area, providing high-quality tourism services of national and international stature. Many people expect the project to create a "boost" for the tourism industry, contributing to making Quang Binh a tourist center of Southeast Asia.

However, after a series of massive implementation plans, the project has stopped operating for more than a year. Public opinion believes that the main reason is that Mr. Trinh Van Quyet, Chairman of FLC Group, was arrested by the Investigation Police Department, Ministry of Public Security in March 2022. However, after Mr. Quyet was arrested, FLC Group issued Document No. 182/FLC-BĐT to the provinces and centrally-run cities, including Quang Binh, to reassure that the incident absolutely does not affect or change the important orientations of FLC in production, investment, business activities as well as sustainable development in the coming time; at the same time, it also does not affect the rights and legitimate interests of customers, shareholders, and partners who are transacting and cooperating with the group. Investment activities in all projects of FLC Group are still being implemented to ensure the progress and plan as set out.

Also according to the above document, in Hai Ninh commune (Quang Ninh), FLC Group is currently investing in the FLC Quang Binh super resort complex including the following items: FLC Quang Binh International Convention Center; 5-star hotel complex, international restaurant chain, outdoor stage, golf course... Currently, FLC Group is directing contractors and construction units to urgently complete a number of items of the conference center project, resort hotel, resort villa area... striving to complete and put into use in 2022.

However, the current situation of the project is a prolonged "silence", and makes many people worried.

Many lawsuits claim deposit

According to statistics from the People's Court of Quang Ninh district, in Hai Ninh commune alone, from 2020 to March 2024, the unit has handled 27 deposit contract disputes between individuals and brokerage units or "subsidiary" units of FLC Quang Binh Company.

Typically, in 2023, the Trial Panel (HDXX) of the People's Court of Quang Ninh District forced FLC Quang Binh Beach & Golf Resort Company Limited to pay Ms. LQH in Hanoi the entire deposit of nearly 1.1 billion VND and a fine of more than 313 million VND. According to Ms. H.'s lawsuit, in 2018, through FLC Quang Binh Beach & Golf Resort Company Limited, which introduced itself as a brokerage consultant and exclusive real estate sales organization invested by FLC Group in Hai Ninh commune, Ms. LQH decided to buy a Houston Shophouse property with a land area of 120m2, worth more than 2.8 billion VND.

A leader of Quang Ninh district said that more than anyone else, the people and local authorities are looking forward to the project continuing to be implemented as promised by the investor. Because, with such a large-scale project, if it does not become a reality soon or is delayed for a long time, it will cause great waste and easily lead to unnecessary consequences.

According to the signed documents, Ms. H. complied with the agreement and completed the deposit on time on December 10, 2018, with an amount of nearly 1.1 billion VND. Also according to the agreement, FLC Quang Binh Company is obliged to hand over the property no later than April 2019. In case of delay of more than 6 months from April 2019, the seller has not fulfilled the agreement to sign the contract, must return the deposit and the compensation for damages calculated on the deposit amount, with an interest rate of 150%. However, up to now, FLC Quang Binh Company has not performed as committed and has violated the signed agreement. It is worth mentioning that although the People's Court of Quang Ninh District has summoned the defendant many times, the unit with related rights and obligations, FLC Group, was not present, nor did it respond. The People's Court of Quang Ninh District held a trial in absentia for the defendant.

Similarly, also in 2023, the People's Court of Quang Ninh District forced FLC Quang Binh Beach & Golf Resort Company Limited to return more than VND 350 million to Mr. C.Kh.H. in Ha Tinh Province and over VND 83 million in late payment interest. According to a leader of the Provincial People's Court, regarding the above-mentioned deposit contract dispute lawsuits, the parties involved and the defendants all filed appeals to the Provincial People's Court. However, after reviewing the documents and evidence, the Provincial People's Court's panel of judges upheld the first instance judgment.
