On December 31, 2024, the Chairman of the Provincial People's Committee, Le Van Dung, signed a document requesting the Party Secretaries of Thang Binh, Hiep Duc, and Phuoc Son districts to focus on leading and mobilizing the entire political system to continue urgently and actively participating in organizing propaganda, persuasion, and explanation to clear land for the project to renovate and upgrade National Highway 14E. The Chairmen of the People's Committees of these districts are to decisively and resolutely direct the completion of compensation, land clearance, resettlement, and handover of all land to Project Management Board 4 (the project management unit) before March 1, 2025. This is the final deadline; there must be no delay.

However, reporting to Vice Chairman of the Provincial People's Committee Tran Nam Hung during a land clearance inspection last week, Project Management Board 4 stated that the main bottlenecks remain in Thang Binh and Hiep Duc districts. In Hiep Duc, the district has handed over 26.83/30.2km (88.84%) of the land. Notably, within the handed-over area, a 1.2km section is inaccessible for the construction of the Viet An bypass (Binh Lam commune). In Thang Binh, the district has handed over 14.86/17.4km of land (85.4%), but many sections have been handed over in a piecemeal fashion. The biggest bottleneck is the unfinished land clearance for the railway overpass (Binh Quy commune).

During the inspection, Comrade Tran Nam Hung listened to the concerns and suggestions of several households in the area where the railway overpass will be built. Regarding the request for compensation and support for garden and pond land attached to residential plots, the provincial leader explained to the people that according to the 2024 Land Law and current regulations of the Central and provincial governments, garden and pond land attached to residential land is clearly compensated as agricultural land (not supported at 50% of the residential land price as before). This regulation is applied uniformly nationwide.

In cases where, despite repeated persuasion and appeals, individuals deliberately delay or refuse to comply with the state's policy on compensation and land clearance, the provincial leadership requests that Thang Binh and Hiep Duc districts resolutely organize the forced land recovery in accordance with the law. Project Management Board 4 will commence construction of the railway overpass in February 2025; and complete the entire project before October 2025.

Addressing numerous requests

Following the inspection, Comrade Tran Nam Hung instructed the Secretary of the District Party Committee and the Chairman of the Thang Binh District People's Committee to focus on leading and directing the entire political system to actively propagate and mobilize the people to comply with the compensation plan and agree to hand over the land.

Study and apply all legal and provincial regulations to consider and provide maximum compensation and support to affected households, contributing to the early stabilization of their lives, production, and living conditions, and ensuring the maximum protection of the legitimate rights and interests of the people. In cases of non-compliance, land will be forcibly reclaimed in accordance with regulations before March 15, 2025.

Regarding the petition from some households at the railway overpass intersection, the provincial leadership requested Thang Binh to take the lead and coordinate with relevant agencies and units to thoroughly review the land-related documents of Mr. Dang Ha's household (provided by the family) and the land use history over the years to re-determine the residential land area in accordance with regulations. At the same time, they directed the urgent re-measurement of the land area to be reclaimed from the household, inviting family representatives to witness and confirm the process before proceeding with the next steps.

Mr. Dang Van Hung's household has a large area of ​​land subject to expropriation, with a wide existing frontage, making it convenient for daily business and living. Therefore, the provincial leadership has agreed to direct Thang Binh district to research and fully utilize current regulations to consider allocating a second (adjacent) plot of land within its authority. The household will be allocated one kiosk at Binh Quy market for business purposes, with a six-month rent waiver.

The district is urging Mr. Hung's household to comply with the policy and hand over the land promptly. Initially, the household will temporarily lend an area of ​​land that does not affect their house for the construction of a service road leading to the railway overpass. Mr. Hung's compliance and agreement will serve as the basis for considering and resolving the matter according to the aforementioned policy. Regarding Mr. Nguyen Van Duy An's household, the provincial leadership has agreed on the policy of allocating two adjacent resettlement plots; the district will direct the review and implementation of compensation and support in accordance with regulations.

In Hiep Duc, regarding cases where production forest land is affected, which according to cadastral records is classified as 5% land, the provincial leadership requested the district to urgently conduct an inventory, record the current status, and hold meetings with households to publicly disclose and issue written commitments to compensate according to the land type currently in use (production forest) after completing the procedures to remove it from the 5% land classification; and to encourage the handover of the land by February 2025 for the construction of the Viet An bypass.

In the remaining cases, the district leadership directed the entire political system to actively propagate and mobilize the people to comply with the compensation and land clearance plan; and hand over the entire land area by March 2025.
