Regarding rest periods, Decree 12/2022/ND-CP clearly stipulates the penalties for employers who violate the regulations.
Specifically, employers will be fined between 10 and 20 million VND for violating regulations on weekly rest, annual leave, and public holidays; and between 2 and 5 million VND if they fail to ensure employees are given personal leave or unpaid leave as prescribed, or fail to notify the Department of Labor, War Invalids and Social Affairs (now the Department of Interior) in writing about organizing overtime work exceeding 200 to 300 hours per year.
Holidays and Tet (Lunar New Year) leave are basic rights. Businesses are required to arrange holiday schedules in accordance with regulations. If employers need to mobilize personnel to work on these days, they must obtain the employees' consent and pay them full overtime pay.
