Livestream, use patient's images and medical records to post videos online, is that okay?

Currently, social networks are flooded with videos containing images, prescriptions, sounds of patients being consulted, examined, even livestreamed... Some of which are posted by doctors themselves.

To promote their personal image or recommend disease prevention, more and more doctors "innocently" post images and videos of patients' examination and treatment processes on social media channels such as TikTok, Facebook...

Videos with images and sounds of sick people are everywhere.

According to Tuoi Tre Online, on the social network TikTok, there are many videos posted by doctors with images and sounds of patients.

Specifically, a TikTok account named T. introduces herself as an obstetrician and gynecologist with more than 1 million followers who regularly posts videos about reproductive health check-ups (mainly women) and women's childbirth.

Most of the videos mask the patient's face, but the patient's audio remains intact.

The content of the videos posted by Dr. T. is mainly about women who have difficulty conceiving due to polycystic ovaries, few or no eggs, no menstruation, old age... For men, there is no sperm or weak sperm.

This doctor also posts many videos about reproductive knowledge or babies born from birth to several years old thanks to his artificial insemination. Among them are many cases of twins, triplets, and even quintuplets, which he considers "reproductive miracles".

Or a TikTok account claiming to be "OB/GYN LP" who regularly livestreams while examining women at his clinic. Because he livestreams, viewers can see all the conversations between doctors and patients.

Like the live broadcast that lasted more than half an hour on the morning of May 27. The camera angle recorded the activities of this doctor and staff examining the patient...

During the live broadcast, the broadcaster did not notify the patient.

Although the camera angle mainly records the activities of people in the clinic, sometimes patients accidentally appear in the live recording frame.

On this account's timeline, almost every day there are videos posted about ultrasounds, IUD placement, intimate hygiene... including advertisements for products related to women's reproductive health and beauty.

Besides some doctors who directly use images and videos of patients, there are also many doctors who only film themselves, along with illustrations and models to convey medical knowledge to the public.

Not only images, but also videos of patients during examinations, prescriptions, and test results are still widely posted on social networks without the posters covering the necessary information to protect the patient's privacy.

There are cases where advertising agencies even compare before and after photos of patients undergoing cosmetic surgery.

Even now, social networks are constantly filled with images and medical records of a patient in a pitiful situation, with no money for treatment... for profit.

All information and images must be kept confidential unless the patient agrees.

Sharing with Tuoi Tre Online , a doctor working at a public hospital in Ho Chi Minh City said that the first principle that is disseminated to all doctors and medical staff is to respect the privacy of patients.

Without the patient's consent, medical staff are not allowed to post or disclose patient medical records or images. This is also clearly stated in the Law on Medical Examination and Treatment.

“Patients’ information needs to be protected and respected because it can affect their psychology, work, and relationships. Therefore, this is a principle of professional ethics in medicine,” said the doctor.

According to the Law on Medical Examination and Treatment 2023 (effective from January 1, 2024), it is necessary to respect the patient's privacy, keep personal information and medical records confidential, including images and videos during the examination and treatment process.

Medical examination and treatment facilities and medical staff must keep confidential all information related to patients.

Photographing and filming are permitted when the patient agrees in writing or verbally, with recording and legal storage, for the purposes of diagnosis and treatment, professional training, consultation, research or communication.

Previously, the Ho Chi Minh City Department of Health sent a document to medical facilities requesting that medical staff strictly comply with legal regulations on the right to protect personal images, the right to respect patient privacy, and regulations on providing and posting information on social networks.
