Pursuant to the Law on Promulgation of Legal Documents dated June 22, 2015; Law on Amending and Supplementing a Number of Articles of the Law on Promulgation of Legal Documents dated June 18, 2020;
Pursuant to the Law on Animal Husbandry dated November 19, 2018;
Pursuant to Decree No. 13/2020/ND-CP dated January 21, 2020 of the Government detailing the Law on Animal Husbandry; Decree No. 46/2022/ND-CP dated July 13, 2022 of the Government amending and supplementing a number of articles of Decree No. 13/2020/ND-CP dated January 21, 2020 of the Government detailing the Law on Animal Husbandry;
Pursuant to Decree No. 106/2024/ND-CP dated August 1, 2024 of the Government regulating policies to support improving livestock farming efficiency;
Considering Submission No. 156/TTr-UBND dated November 11, 2024 of the People's Committee of Nam Dinh province on the draft Resolution on Regulations on areas within the inner city of cities, towns, and residential areas where livestock farming is not allowed; areas for raising swiftlets; support policies when relocating livestock facilities out of areas where livestock farming is not allowed in Nam Dinh province; Verification report of the Economic - Budget Committee of the Provincial People's Council; discussion opinions of the Provincial People's Council delegates at the session.
RESOLUTION:
Article 1. Regulations on areas within the inner city of cities, towns, and residential areas where livestock breeding is not allowed (hereinafter referred to as areas where livestock breeding is not allowed) except for raising ornamental animals and raising animals in laboratories without causing environmental pollution in Nam Dinh province, as follows:
1. Nam Dinh City:
a) Wards: Cua Bac, Nang Tinh, Quang Trung, Tran Hung Dao, Vi Xuyen.
b) Residential groups No. 1, 2, 3, 4, 5, 6, 7, 8, 9, 10, 11, 12, 13, 14, 15, 16, 17, 18, 19, 20, Truong Thi ward.
c) Residential groups: Phuc Trong 1, Phuc Trong 2, Phuc Trong 3, My Xa ward.
d) Residential group 1 Tan An, Loc Hoa ward.
d) Residential groups No. 1, 2, 3, 4, 5, Cua Nam ward.
e) Residential groups No. 2, 8, Loc Ha ward.
g) Residential groups No. 1, 2, 3, 7, 8, 9, 10, 11, 12, 13, Loc Vuong ward.
h) Dang Xa residential group, Hung Loc ward.
i) Residential group 8, Nam Van ward. k) Residential group Ngo Xa, Nam Phong ward.
2. Vu Ban District: Tran Huy Lieu Residential Group, Goi Town.
3. Nam Truc District: Residential groups No. 9, 10, 11, 15, Nam Giang town.
4. Truc Ninh District: Tran Phu residential group, Co Le town.
5. Nghia Hung District:
a) Residential groups No. 1, 2, Lieu De town.
b) Residential group No. 2, Quy Nhat town.
c) Dong Binh residential group, Rang Dong town.
6. Giao Thuy District:
a) Quat Lam tourist area, Quat Lam town.
b) Dong Tien residential group, Giao Thuy town.
7. Hai Hau District:
a) Thinh Long tourist area, Thinh Long town.
b) Residential groups No. 1, 2, 3, Yen Dinh town.
c) Residential groups No. 1, 3, 4, Con town.
8. Xuan Truong District: Residential Group No. 3, Xuan Truong Town.
9. District of Y Yen: Residential group number 8, Lam town.
10. Urban areas, concentrated residential areas, concentrated residential and resettlement areas, industrial parks, and industrial clusters are decided by competent authorities on investment policies in districts and cities of Nam Dinh.
Article 2. Regulations on bird's nest farming areas
1. Swiftlet farming area in Nam Dinh province: is an area outside the area specified in Article 1 of this Resolution and outside the residential area. Swiftlet houses must be at least 300m away from the residential area.
2. Organizations and individuals engaged in swiftlet farming activities in swiftlet farming areas must comply with the provisions of Clause 3, Article 64 of the Law on Animal Husbandry No. 32/2018/QH14, Clause 2, Article 25 of Decree No. 13/2020/ND-CP dated January 21, 2020 of the Government detailing the Law on Animal Husbandry and relevant legal provisions.
Article 3. Support policy when relocating livestock facilities out of areas where livestock farming is not allowed
1. Supported subjects One-time support for organizations and individuals with livestock facilities built and operating before the effective date of the Law on Livestock and operating in areas where livestock farming is not allowed as prescribed in Article 1 of this Resolution will be supported to relocate to a new suitable location or stop operations and change occupations.
2. Content and level of support
a) Support not exceeding 50% of the cost of purchasing construction equipment and livestock technology equipment according to the existing barn area of the livestock facility subject to relocation; the maximum support level is not more than 10 billion VND/facility.
b) Support no more than 50% of the cost of moving animals to a new suitable location; the maximum support level is no more than 500 million VND/facility.
c) Support 100% of training costs to convert from animal husbandry to other occupations; the maximum support level does not exceed 03 months of basic salary/person.
3. Supported conditions
a) Livestock facilities built and operating before the effective date of the Law on Livestock and operating in areas where livestock farming is not permitted are subject to relocation according to current regulations.
b) People who are trained to convert from animal husbandry to other occupations must have a certificate of completion of the training course issued by the training institution and commit to performing the converted occupation for at least 05 years after receiving support.
c) Support for the support content specified in Points a, b and c, Clause 2 of this Article shall be implemented after the livestock facility has completed the relocation out of the area where livestock farming is not allowed or has stopped operations or changed its business line with confirmation from the People's Committee at the commune level.
4. Principles for implementing support policies Implement according to Article 4 of Decree No. 106/2024/ND-CP dated August 1, 2024 of the Government regulating support policies to improve the efficiency of farming.
5. Applicable time: Livestock facilities must cease operations or relocate to a suitable location before January 1, 2025.
6. Capital
a) State budget.
b) Other legally mobilized capital sources.
7. Support procedures and processes
a) The order and procedures for support for the content specified in Point a, Clause 2, Article 3 of this Resolution shall be implemented in accordance with Article 13 of Decree No. 106/2024/ND-CP dated August 1, 2024 of the Government stipulating support policies to improve livestock farming efficiency;
b) The order and procedures for support for the content specified in Point b, Clause 2, Article 3 of this Resolution shall be implemented in accordance with Clause 1, Article 14 of Decree No. 106/2024/ND-CP dated August 1, 2024 of the Government regulating support policies to improve livestock farming efficiency.
c) The order and procedures for support for the content specified in Point c, Clause 2, Article 3 of this Resolution shall be implemented in accordance with Clause 3, Article 14 of Decree No. 106/2024/ND-CP dated August 1, 2024 of the Government regulating support policies to improve livestock farming efficiency.
Article 4. The Provincial People's Committee is assigned to organize the implementation of the Resolution and take full responsibility before the law and the Provincial People's Council for the effectiveness and feasibility of the contents stipulated in the Resolution.
Article 5. The Standing Committee of the People's Council, the People's Council Committees, the People's Council Delegation Groups and the Provincial People's Council delegates shall supervise the implementation of the Resolution. This Resolution was passed by the 19th Nam Dinh Provincial People's Council, 22nd Session on December 10, 2024, effective from December 20, 2024.
