People are still waiting anxiously for their land ownership certificates.

Over 10 years have passed without a land ownership certificate.

Accordingly, residents of Lakeview City apartment complex (Thu Duc City) have requested that difficulties be resolved and that ownership certificates be issued for 960 apartments, as they have purchased and paid 95% of the contract value to the developer.

At Hoang Anh - Thanh Binh apartment complex (District 7), residents have complained that they have not received their ownership certificates for over 10 years and are requesting measures and sanctions to compel the developer to complete the procedures for issuing them. Not far away, residents who bought apartments at Duc Khai apartment complex in 2014 have still not received their ownership certificates.

For over 10 years, residents of Hoang Anh Thanh Binh apartment complex have been eagerly awaiting the issuance of their ownership certificates, but to no avail.

At Oriental Plaza apartment complex (Tan Phu district), 1,136 apartments have been in use since 2017, but only 275 have been granted ownership certificates, while the rest are still waiting. Residents are petitioning the authorities to quickly resolve the issues so that the investor can continue to hand over ownership certificates to residents and stabilize their lives.

Thousands of residents living in Kingdom 101 apartment building (District 10) have also reported that they have not received their ownership certificates despite having moved in since June 2020 and fulfilling their financial obligations to the developer.

Issue land ownership certificates to residents first.

Responding to voters' petitions regarding the Lakeview City project, the Department of Natural Resources and Environment stated that, according to regulations, after the completion of the project, the investor is responsible for submitting to the Department of Natural Resources and Environment the certificate or decision on land allocation or land lease from the competent authority; documents proving the fulfillment of financial obligations; and in case of changes in financial obligations, documents proving the completion of those changes must be submitted. Therefore, the issuance of land ownership certificates to residents of the project can only be carried out when the investor has completed all financial obligations. Meanwhile, this project is currently determining its financial obligations based on the conclusions of the Government Inspectorate in December 2020.

At the Hoang Anh - Thanh Binh apartment complex, the investor, Thanh Binh Construction Investment Consulting Co., Ltd., is requesting the District 7 People's Committee to consider approving the adjustment of the 1/500 detailed planning of the project according to the current construction status. The investor has also not yet been granted ownership certificates due to incomplete financial obligations. Therefore, the issuance of ownership certificates to homebuyers in the project cannot yet be carried out.

The Department of Natural Resources and Environment recommends issuing land ownership certificates to residents first.

Regarding the Duc Khai apartment complex, developed by Duc Khai Joint Stock Company, the Department of Natural Resources and Environment reported that Block B of the project covers nearly 20,000 , comprising four blocks: B1, B2, B3, and B4. Block B4 has already been handed over to the District 7 People's Committee for resettlement. The Ho Chi Minh City Land Registration Office is processing land use right certificates (pink books) for residents in blocks B1, B2, and B3. However, Duc Khai Joint Stock Company has mortgaged the land use rights for three certificates issued for blocks B1, B2, and B3 at a bank, and these have not yet been released. Furthermore, the process of offsetting the construction cost of block B4 against the land use right value has not been completed. Therefore, there is no basis for issuing land use right certificates to homebuyers in this project.

Regarding the Oriental Plaza apartment building, since 2018, the Department of Natural Resources and Environment has issued a document requesting the investor, Son Thuan Company, to fulfill additional financial obligations and adjust some units due to construction errors. In 2020, the Department issued a document requesting the Ho Chi Minh City Land Registration Office to issue ownership certificates for the apartments, but excluding some units where the investor must fulfill additional financial obligations. The Land Economics Division of the Department of Natural Resources and Environment is currently calculating the additional financial obligations related to this project because the planning needs to be adjusted.

Regarding the Kingdom 101 project, the investor, KingDom Indochina Joint Stock Company, has completed construction (phase 1) and handed over houses to customers since 2020. Inspection of the current land use status, housing, and conditions for transferring land use rights and selling houses shows that the project meets the requirements for issuing ownership certificates to homebuyers. However, the project is still facing obstacles in allocating resettlement housing and social housing due to delays in calculations by relevant authorities. Therefore, waiting for the completion of the aforementioned issues will further prolong the issuance of ownership certificates to homebuyers, inevitably leading to frustration and numerous complaints.

Furthermore, the aforementioned issues were directed in 2016 and 2020, but to date, the agencies assigned to lead the matter have not provided feedback or reported to the Ho Chi Minh City People's Committee, which is also partly the responsibility of the state agencies. Therefore, the Department of Natural Resources and Environment proposes that the Ho Chi Minh City People's Committee approve the Department of Natural Resources and Environment to guide and resolve the issuance of land ownership certificates to homebuyers first. The remaining issues at the project will be resolved later by the relevant authorities.

According to a report by the Ho Chi Minh City Department of Natural Resources and Environment, in the first nine months of 2023, Ho Chi Minh City issued 5,480 land ownership certificates (pink books) to organizations and individuals. Thus, out of a total of over 81,000 houses that have not yet been issued land ownership certificates, approximately 75,000 remain unregistered. The target set for 2023 is for Ho Chi Minh City to issue land ownership certificates to 20,300 houses.
