
On the morning of November 27th, the National Assembly voted to pass the People's Air Defense Law, tightening many regulations on controlling unmanned aerial vehicles.
A drone is any type of aircraft that can fly without a pilot directly controlling it. In addition to drones and flycams, balloons, model aircraft, parachutes, kites (excluding traditional kites), and similar devices are also subject to regulation.
All organizations and individuals wishing to use these vehicles must obtain permits and comply with regulations regarding notification and flight coordination.
The pilot must be at least 18 years old, have full civil capacity, and possess a pilot's license. Foreign pilots must have a Vietnamese national or organization or individual acting as a guarantor.
The Minister of National Defence and the Minister of Public Security shall prescribe the conditions for operators of unmanned aircraft and other specialized flying vehicles serving national defence and security missions.
Authorities may suspend flights for reasons of national defense, security, and flight safety, or upon detecting violations of flight permits; unqualified pilots; or unregistered or improperly registered unmanned aircraft.
Aircraft will be suppressed and detained if they fly illegally; fly into no-fly zones or restricted airspace without permission; fail to comply with flight suspension orders; or encroach upon airport or airfield areas where civil or military aircraft are operating.
Those using drones or other flying vehicles to propagate, incite, entice, or distort information against the Party and the State, or to commit other illegal acts; carrying equipment, weapons, explosives, prohibited substances, or transporting illegal goods will also be suppressed.
Building a people's air defense system.
The law stipulates the division of responsibilities and close coordination between air defense forces and agencies, organizations, businesses, and individuals in protecting airspace.
The people's air defense system is built on the combined strength of the entire political system and the whole population to ensure national security and sustainable development. Air defense operations are meticulously prepared, carried out regularly, and are ready to respond to any situation.
Currently, the People's Air Defense Force is equipped with weapons with a range exceeding 5,000 meters; and with air defense reconnaissance equipment capable of observing and detecting targets at various altitudes. Therefore, the People's Air Defense Force is fully capable of participating in the management and protection of airspace below 5,000 meters.
The focus of air defense will be on key targets that need protection, and the main routes of enemy airborne landings or ground attacks.
The Law on People's Air Defense will take effect from July 1, 2025.
