On November 5th, the People's Court of Dak Nong province opened the first-instance trial of a criminal case related to irregularities that occurred at the Nhan Co Industrial Park Project.
This case involves six defendants. Four of them are being tried for "Negligence Causing Serious Consequences," including: Dang Gia Dung (former Director of the Department of Construction of Dak Nong province), Ho Si Diep (former Deputy Director of the Investment and Construction Project Management Board of Dak Nong province), Tran Quoc Dat (Head of Project Department 1, Investment and Construction Project Management Board of Dak Nong province), and Dang Thai Son (Director of the Project Management and Land Development Board of Dak Mil district, former civil servant of the Construction Quality Management Department under the Department of Construction of Dak Nong province).
The trial is expected to last three days, from November 5th to November 7th, 2024.
Two defendants are being tried for the crime of "Violating construction regulations causing serious consequences," including Pham Van Cuu (former General Director of Duong Viet Investment and Construction Joint Stock Company) and Nguyen Thanh Ha (former Head of Design Department 1 - Duong Viet Investment and Construction Joint Stock Company).
Previously, this case had been brought to trial and postponed twice (in September and October 2024) due to the absence of many involved parties. This time, 5 out of 6 defendants were present at the trial.
Defendant Dang Gia Dung (former Director of the Dak Nong Department of Construction) has been determined to have lost his civil capacity due to a history of mental illness, as decided by the Buon Ma Thuot City People's Court, Dak Lak province. The legal representative of defendant Dung submitted a request to be absent from the trial.
Representatives of the subcontractors who acquired the rights from the main contractors were not present at the trial. The panel of judges deliberated and concluded that the absence of those with relevant rights and obligations did not affect the nature of the case. Therefore, the trial continued as prescribed.
According to the Dak Nong Provincial People's Court, the case is scheduled to be heard over three days, from November 5th to 7th, 2024.
The project for technical infrastructure inside and outside the fence of Nhan Co Industrial Park (Dak R'lap district, Dak Nong province) was approved in 2015 with a total investment of nearly 1,000 billion VND, and is expected to be completed by the end of 2020.
According to the indictment, during the survey and design process of the "Land Leveling and Slope Protection" item (Package 02XL) of the Project, the six defendants committed violations. As a result, from 2018 to 2020, during the construction of Package 02XL, there were five incidents of landslides, causing damage exceeding 55.6 billion VND.
This problem remains unresolved to this day, and the Nhan Co Industrial Park project has been suspended for many years.
