Commune level used to have 97 job positions
Answering reporters VTC News Electronic Newspaper , Dr. Nguyen Tien Dinh, former Deputy Minister of Home Affairs, said that the guidance of the Ministry of Home Affairs will be an important basis for commune-level administrative units to identify, arrange, and use cadres and civil servants according to functions and tasks in accordance with the 2-level local government model.
Mr. Dinh said that after the Law on Cadres and Civil Servants 2008 and the Law on Public Employees 2010 were promulgated, we have implemented the determination of job positions.
Most recently, Decree No. 62/2020 of the Government (on job positions and civil servant payroll) and 15 guiding circulars of ministries and branches on job positions, the commune level has up to 97 job positions for commune-level civil servants.
" Up to now, the Government still requires ministries, branches and localities to continue to review and determine standard job positions. Even the matter of paying salaries according to job positions in the spirit of Resolution No. 27 has not been implemented because the determination of job positions is not standard and not guaranteed, although the ministries, branches and localities have all approved it, " said former Deputy Minister Nguyen Tien Dinh.
Mr. Dinh pointed out that in the past, the commune, district, provincial levels and ministries and branches determined job positions themselves. There were cases where one civil servant was one job position, leading to a large number of job positions.
However, according to Dr. Dinh, by the Law on Cadres and Civil Servants 2025, this job position has made great progress compared to the previous requirements for determining job positions. Based on this law, the Ministry of Home Affairs, based on functions and tasks, has oriented job positions for the commune level to reduce to only 36 positions, including 8 leadership and management positions and 28 professional and technical positions arranged by industry and field.
" Thus, the Ministry of Home Affairs determines that a job position may require many officials or civil servants to do it, or one official or civil servant may do many different job positions. For example, a senior specialist can do many jobs. From there, we can ensure the process of streamlining the apparatus and reducing staff according to the Central's requirements ," Mr. Nguyen Tien Dinh emphasized.
Sharing the same view, Mr. Nguyen Duc Ha, former Head of the Party Base Department (Central Organization Committee) said that clearly defining job positions will help shape the commune-level payroll framework and determine the specific tasks of each cadre and civil servant.
However, Mr. Ha especially noted that with new task requirements, the team of commune-level cadres must improve their qualifications, knowledge and capacity must also be comprehensive.
" A cadre needs to be like a kitchen knife, able to chop, split, and slice. A cadre is good at one thing but can do many other things, " said Mr. Ha.
Urgently supplement human resources for commune level
In the immediate future, the Ministry of Home Affairs requires the People's Committees of provinces and cities to ensure the minimum number of civil servants in administrative organizations at the commune level, according to the instructions in Official Dispatch 09/2025 of the Steering Committee for the arrangement of administrative units at all levels and the construction of a 2-level local government organization model of the Government.
From there, determine the number of missing civil servants to urgently supplement human resources (especially in the fields of information technology and digital transformation, accounting, land administration, and construction at the commune level) and positions directly serving people and businesses.
Regarding this issue, Mr. Nguyen Tien Dinh acknowledged that this is an open direction for localities, meeting human resources to operate a two-level government.
" After the merger, the Central Government allowed the number of civil servants to remain the same and the restructuring would be stable within 5 years. However, after 2 months of operation, many areas such as cadastral, land, environment... are facing work overload ," said Mr. Dinh.
The former Deputy Minister of Home Affairs said that the management agency allows the transfer of civil servants between communes and wards to suit the practical tasks, ensuring the right person, right job, right expertise and profession according to Conclusion No. 183 of the Politburo and Secretariat (on actively implementing the operation of the 2-level local government model, strongly shifting the grassroots level to proactively grasp and manage the socio-economy, national defense and security).
In addition, localities can sign labor contracts with people with expertise and skills that immediately meet job requirements (priority given to majors in information technology and digital transformation, accounting, land administration, construction, etc.) according to regulations.
" It is possible to sign contracts with personnel working in the non-state sector to perform civil servant duties. This is a very new form to meet the immediate needs of the task, helping localities overcome initial difficulties in human resources and operate smoothly at two levels of government, " said Mr. Dinh.
In addition, Mr. Nguyen Tien Dinh assessed that the examination, selection or reception of civil servants according to the provisions of Decree 170/2025 of the Government within the number of positions assigned by competent authorities but not yet used is also a new step to help localities attract talents to work in the State administrative apparatus, helping to improve the quality and capacity of civil servants. communal civil servants
