Shine Clinic shows signs of operating beyond the scope of its license?

According to information from the District 3 Health Department, there are currently 2 business registration certificates in operation at 6 Truong Quyen. The first is Shine Clinic & Spa with the business owner being Mr. Nguyen Phi Nhat, the registered business is skin care. Data on the Department of Health's lookup system also clearly states that this business is not allowed to perform cosmetic services.

The second business registered at 6 Truong Quyen is Shine Clinic, with the owner being Ms. Huynh Thi Thuy Nga, with the registered business line being "Dermatology Clinic".

This business household was also granted a medical examination and treatment license number 04324 by the Ho Chi Minh City Department of Health on June 30, 2023. The clinic's daily working hours from Monday to Friday are from 5:00 p.m. to 8:00 p.m., and from 8:00 a.m. to 7:00 p.m. on Saturday and Sunday.

From the advertisement content, it can be seen that Shine Clinic was operating before being licensed on June 30, 2023.

Thus, only after being licensed, Shine Clinic can operate as a Dermatology clinic in accordance with medical examination and treatment regulations at 6 Truong Quyen.

However, through research on the clinic's Fanpage "Shine Premium", it can be seen that Shine Clinic has provided facial treatment services such as treating pitted scars, acne, and melasma to customers nearly a year before being granted an operating license.

It is worth mentioning that since the end of 2022, many advertisements of Shine Clinic show that this facility also provides cosmetic services such as nasolabial fold shaping, lip shaping, eye hollow improvement with filler and botox injection techniques...

The provision of this cosmetic service is also shown on the clinic’s signboard with the advertisement content as “Aesthetic Dermatology Clinic”. Meanwhile, Shine Clinic has not been granted a license to operate a cosmetic clinic.

In addition, regarding working hours, Shine Clinic consultants also advised customers to pick up guests from 9am to 6pm, which is not in accordance with the operating hours registered in the above operating license.

Ever been punished by authorities

Responding to the Journalist and Public Opinion Newspaper, the District 3 Health Department said that on April 26, 2023, the Health Department conducted an inspection and proposed that the District 3 People's Committee issue Decision 328/QD-XPHC dated May 5, 2023 on administrative sanctions in the health sector against Dr. Huynh Thi Thuy Nga, who is in charge of the professional responsibility of the Shine Clinic Dermatology Clinic.

The authorities determined that this clinic had violated the regulations on operating conditions and use of medical examination and treatment licenses at Point c, Clause 1, Article 39 and violated the regulations on technical expertise in medical examination and treatment at Point d, Clause 1, Article 40 of Decree 117/2020/ND-CP regulating administrative sanctions in the medical field with a fine of 4 million VND.

Shine Clinic has used advertisements that show signs of infringement when using the word world number 1.

On the same day, District 3 People's Committee also issued Decision 329/QD-XPHC against Mr. Nguyen Phi Nhat - owner of Shine Clinic & Spa business for violating regulations on retail sale of drugs and medicinal herbs at Point a, Clause 5, Article 59 of Decree 117/2020/ND-CP with a fine of 25 million VND. District 3 Health Department said it will continue to coordinate with functional units of the district and the Ward People's Committee to continue monitoring the operation of the facility.

Despite being punished by the authorities, Shine Clinic is still maintaining medical examination and treatment activities that appear to exceed the scope of its operating license. Not to mention, doctors operating at the clinic are also showing signs of not performing within the scope of their issued practice certificates regarding registration of operations and operating time.
