Accordingly, with 426 National Assembly deputies voting in favor, representing 89.87% of the total number of deputies, the National Assembly passed the Extradition Law.
The Extradition Law consists of 4 chapters and 45 articles. Presenting the report explaining the amendments and revisions to the draft law, the Chairman of the National Assembly's Committee on Law and Justice, Hoang Thanh Tung, stated that during the discussions, some National Assembly deputies proposed raising the minimum sentence to 2 years imprisonment or more for cases eligible for extradition.

According to the delegates, such regulations are intended to ensure effective international judicial cooperation, avoid wasting administrative resources on minor cases, and demonstrate a humane policy of extradition only for those whose actions are truly serious and pose a danger to society.
According to the explanation from the National Assembly Standing Committee, the provision of a minimum sentence of one year imprisonment as stipulated in the draft law is inherited from the current law, is consistent with international practice and commitments in extradition agreements that Vietnam has signed, aiming to ensure flexible and timely cooperation in many cases and is not limited to serious crimes.
In fact, the competent authority may consider the possibility of extradition for a person who has committed an offense punishable by a one-year prison sentence, but who plays a crucial role in resolving the case.
Furthermore, the humanitarian policy of our State is ensured through a case-by-case review mechanism, not by adding criteria regarding the severity of the punishment. Raising the minimum prison sentence threshold would lead to the inability to extradite cases with low sentences, even those with clear international impact, reducing the effectiveness of international judicial cooperation and failing to address the risk of human rights violations in specific cases. Therefore, the Standing Committee of the National Assembly proposes that the National Assembly maintain the minimum sentence threshold of one year imprisonment for extradition cases.

Also this morning, with 429 National Assembly delegates voting in favor, representing 90.51% of the total number of delegates, the National Assembly passed the Law on Transferring Persons Serving Prison Sentences. The Law on Transferring Persons Serving Prison Sentences has 4 chapters and 48 articles.

Subsequently, with 426 National Assembly delegates voting in favor, representing 89.87% of the total number of delegates, the National Assembly passed the Law on Mutual Legal Assistance in Criminal Matters. The Law on Mutual Legal Assistance in Criminal Matters consists of 4 chapters and 42 articles.
