
This regulation stipulates the organization and operation of the Jury Panel (including the People's Jury Panel and the Military Jury Panel); the relationship between the Jury Panel and individual jurors; the relationship between the Jury Panel and agencies, organizations, and individuals; the responsibilities of agencies, organizations, and people's armed forces units towards the Jury Panel; and the conditions ensuring the operation of the Jury Panel.
Jury Panels are self-governing organizations of jurors, including: Provincial/City People's Jury Panels; Regional People's Jury Panels; Military Jury Panels of Military Regions and equivalents; and Regional Military Jury Panels.
The panel of lay judges operates on the principles of democracy, openness, and transparency; lay judges who perform their duties in a particular court participate in the activities of the panel of lay judges in the court where that court is located.
The regulations state that the panel of lay judges consists of lay judges elected to perform judicial duties at each provincial and city People's Court (referred to as the provincial-level People's Court) and regional People's Court.
The number of members in each panel of lay judges is determined based on the number of judges in each court.
At the provincial level, for every two judges, there are three lay judges, but the total number of lay judges at a provincial level court must not be less than 20 and not more than 50, while for the Hanoi and Ho Chi Minh City lay judges' groups, it must not exceed 70.
At the regional People's Court, there are 2 lay judges for every 1 judge, but the total number of lay judges at a regional People's Court must not be less than 30 and not more than 100.
The People's Jury Panel consists of a Head, a Deputy Head, and the People's Jury members. The Head and Deputy Head of the People's Jury Panel are elected from among the People's Jury members.
The number of Deputy Heads of the People's Jury Panel is determined according to the size of the People's Jury Panel; there is 1 Deputy Head for a panel with fewer than 30 jurors; and no more than 2 Deputy Heads for a panel with 30 or more jurors.
The Military Jury Panel consists of military jurors appointed to perform judicial duties at military courts of military regions and equivalent levels (referred to as military courts at the military region level), and regional military courts.
The number of members of the Military Jury Panel is determined based on the number of Judges at each Military Court. For every Judge, there are 2 Jury Panels, but the total number of Jury Panels at a Military Court must not be less than 10 and not more than 30.
The military jury panel consists of a head, one deputy head, and military jury members.
Resolution No. 99/2025/UBTVQH15 takes effect from October 1, 2025.
Resolution No. 1213/2016/UBTVQH13 dated June 13, 2016, of the Standing Committee of the National Assembly promulgating the Regulations on the organization and operation of the Panel of Lay Judges, ceases to be effective from the date this Resolution comes into force.
People's assessors for the 2021-2026 term who are performing their duties at the People's Courts of provinces, cities, and regions as stipulated in Clause 7, Article 3 of Resolution No. 225/2025/QH15 dated June 27, 2025, of the National Assembly, shall participate in the activities of the People's Assessors Delegation of the province, city, or region where they perform their duties until the end of their term. The organization and operation of the People's Assessors Delegation shall be carried out according to the Regulations issued together with this Resolution.
