Accordingly, Decree No. 229/2025/ND-CP amended and supplemented Clause 3, Article 87 of Decree No. 63/2023/ND-CP in the direction of completely changing the collection level of fees for granting the right to use radio frequencies (from collected to completely exempted), in order to support telecommunications enterprises when re-issuing licenses.
Specifically, according to Clause 3, Article 87 of Decree No. 63/2023/ND-CP: Organizations that have been granted a license to use frequency bands to establish a public terrestrial mobile telecommunications network that expires before September 6, 2023 must pay a fee for granting the right to use radio frequencies for the remaining term of the license, calculated from July 1, 2023.
The determination of the collection level and the organization of the collection of fees for granting the right to use radio frequencies in this case shall be carried out at the same time as the determination of the collection level and the organization of the collection of fees for granting the right to use radio frequencies when re-issuing a license to use a frequency band to that organization or re-issuing a license to use a frequency band to another organization in the same frequency band.
In Decree No. 229/2025/ND-CP recently issued, the above regulation is amended to: Organizations that have been granted a license to use frequency bands to establish a public terrestrial mobile telecommunications network that expires before September 6, 2023 must pay a fee for granting the right to use radio frequencies for the remaining term of the license from July 1, 2023 at a rate of 0 (zero) VND, which is implemented when re-issuing the license.
Decree No. 229/2025/ND-CP takes effect from August 19, 2025.
According to the Ministry of Science and Technology , Decree No. 229/2025/ND-CP aims to perfect regulations on the collection of fees for granting the right to use radio frequencies, ensuring constitutionality, legality, consistent policies, and fairness among enterprises that have been granted licenses to use frequency bands before the effective date of the 2022 Law on Radio Frequencies (July 1, 2023).
