Launching the handbook on the tasks of commune-level authorities in the fields of agriculture and environment

(Chinhphu.vn) - The Ministry of Agriculture and Environment (MARD) launched a Handbook guiding the tasks and powers of commune-level authorities under the two-level government model in the fields of agriculture and environment. This creates initiative and flexibility for localities in the spirit of "locality decides, locality acts, locality is responsible".

The handbook will be a useful and practical reference document, helping agencies, units and civil servants at the commune level to carry out assigned tasks conveniently.

In order to support commune-level government officials and civil servants to grasp, correctly, fully and effectively perform newly assigned tasks and powers, the Legal Department (Ministry of Agriculture and Environment) has compiled and published the "Handbook on implementing a number of new tasks and powers of commune-level governments according to the 2-level local government model - agriculture and environment sector".

According to Mr. Phan Tuan Hung, Director of the Legal Department, the handbook focuses on introducing and systematically presenting the new tasks and powers of commune-level authorities in the fields of agriculture and environment from July 1, 2025, along with brief instructions on the order, implementation procedures, forms and some notes during the implementation process.

"We hope that the handbook will be a useful and practical reference document, helping agencies, units and civil servants at the commune level to carry out assigned tasks smoothly," said Mr. Hung.

The handbook consists of two parts. The first part introduces some new tasks and powers of commune-level authorities in the fields of agriculture and environment according to the two-level local government organization model. The second part provides some issues to note when implementing the new tasks and powers of commune-level authorities according to the two-level local government organization model.

In the first part, the new tasks and powers of commune-level authorities in 16 agricultural and environmental fields when organizing a two-level local government model will be specified, specifically in fields such as: Cultivation and Plant Protection; Animal Husbandry and Veterinary Medicine; Aquaculture and Fisheries Control; Forestry and Forestry; Irrigation; Dykes and Disaster Prevention and Control; Land; Geology and Minerals; Water Resources; Environment; Nature Conservation and Biodiversity; Hydrometeorology; Sea and Islands; Surveying and Mapping; New Rural Areas and Poverty Reduction; Cooperative Economy and Rural Development.

In the second part, one of the issues that needs attention is the legal validity of documents on decentralization and delegation of authority. Accordingly, the tasks and powers that have been decentralized, delegated, and assigned to commune-level authorities in Decree No. 131/2025/ND-CP and Decree No. 136/2025/ND-CP take effect from July 1, 2025 and expire from March 1, 2027, except for the following cases:

One, Ministries and ministerial-level agencies shall report to the Government for proposal and the National Assembly shall decide to extend the time for applying all or part of the tasks and powers decentralized, delegated, and assigned to commune-level authorities (including implementation procedures) prescribed in the above Decrees.

Second, from July 1, 2025 to March 1, 2027, if there are legal documents of the National Assembly, the National Assembly Standing Committee, the Government, or the Prime Minister that are approved or promulgated from July 1, 2025 and take effect before March 1, 2027 that have provisions on the authority and responsibility for state management of commune-level authorities, the provisions on the authority and responsibility for state management of commune-level authorities in the above Decrees will expire at the time the documents of the National Assembly, the National Assembly Standing Committee, the Government, or the Prime Minister take effect.

The tasks and powers that have been decentralized, delegated, and assigned to commune-level authorities in Decree No. 151/2025/ND-CP (land sector) take effect from July 1, 2025 to before March 1, 2027; except in cases where relevant legal documents have been amended, supplemented, or newly issued to conform to the organization of two-level local authorities, the newly issued legal documents shall apply.
