Strengthening the monitoring of legal documents.

According to Official Document No. 472/UBTVQH15-PL of the Standing Committee of the National Assembly, in recent times, under the leadership and direction of the National Assembly Party Committee and the Standing Committee of the National Assembly, the supervision of legal normative documents has been comprehensively implemented by the National Assembly's agencies and has achieved positive initial results. It has promptly detected and recommended the repeal, replacement, amendment, and supplementation of regulations that are contrary to law, contradictory, overlapping, or no longer consistent with reality, contributing to strengthening the effectiveness and efficiency of law enforcement.

Besides the achievements, the monitoring of legal documents in some areas has not been carried out regularly, remains scattered, and does not closely follow practical realities and the key requirements of socio-economic development to address difficulties and obstacles, or propose solutions to overcome existing problems and limitations in law enforcement.

To further promote the implementation of the Central Committee's and Politburo's resolutions on socio-economic development, and to work alongside the Government and the political system to overcome difficulties and strive to achieve the highest possible socio-economic development plan targets for 2023 and the five-year period (2021-2025), the Standing Committee of the National Assembly requests the National Ethnic Council and the Committees of the National Assembly to focus on strengthening the supervision of legal documents in the fields under their responsibility, with particular attention to the following issues:

Ensure that the monitoring of legal documents is conducted regularly, proactively, and promptly in accordance with the Law on Monitoring Activities of the National Assembly and People's Councils and Resolution No. 560/NQ-UBTVQH15 of the Standing Committee of the National Assembly; focus on substantive monitoring of content, avoid formalism, and prioritize key areas, closely adhering to the requirements and tasks of socio-economic development for each quarter and each year.

Specifically, in 2023, the focus should be on monitoring the following areas: Subordinate legal documents related to resolving difficulties in the real estate market and corporate bonds; bidding and supply of medicines and medical equipment; addressing obstacles in fire prevention and fighting regulations, vehicle registration and inspection, and planning work…

The documents monitored across various fields contain numerous suggestions and feedback from citizens and businesses regarding difficulties and obstacles in the practical implementation of laws related to economic development, production, business, investment, and the use of capital, which need to be resolved and addressed.

The regulations on administrative procedures, specialized inspections, and investment and business conditions contain unreasonable content that causes difficulties, inconvenience, and hinders the operation of businesses; the regulations contain provisions for decentralization and delegation of authority but lack clarity and conditions for ensuring implementation, and do not clearly define responsibilities, inspection mechanisms, and supervision.

Review and monitor documents and regulations related to the authority and responsibility for performing official duties, granting licenses, making investment decisions, and resolving administrative procedures for citizens and businesses; continue reviewing documents to identify loopholes, inconsistencies, and shortcomings that could lead to corruption and negative practices, in order to promptly rectify and overcome the situation of shirking responsibility, working half-heartedly, and being afraid to make mistakes among a segment of officials and civil servants, especially leaders and managers at all levels.

The National Assembly Standing Committee's official letter also requested that attention be paid to the results of monitoring legal documents, clarifying the limitations and obstacles, and the causes of these limitations and obstacles in the documents and their implementation. This includes analyzing and clearly identifying the causes, whether they stem from loopholes, inadequacies, contradictions, overlaps, impracticality in the law or subordinate regulations, or from shortcomings in the organization of law enforcement. Based on this, the responsibilities of agencies, organizations, and individuals involved in the limitations and obstacles should be clearly identified; simultaneously, recommendations should be made to amend, supplement, or issue new documents to address existing shortcomings and limitations, and solutions should be proposed to enhance the effectiveness of law enforcement. For pressing issues arising in socio-economic life related to the application and enforcement of laws, timely accountability sessions should be organized at the National Assembly's Ethnic Council and Committees to address and resolve obstacles, creating immediate changes in state management practices.

The Standing Committee of the National Assembly also suggested that, during the supervision of legal documents, a combination of regular and ad hoc reports should be used. When a document is found to be issued late, shows signs of illegality, has inadequate or outdated content, or negatively impacts socio-economic development, the Standing Committee of the National Assembly's Ethnic Council and the Standing Committees of the National Assembly's Committees should promptly send a document to the agency or person authorized to issue the document requesting a report, information, explanation, or invite the agency or person authorized to issue the document to a meeting to provide information, explanation, and propose solutions. Based on this, a report and specific solutions should be promptly submitted to the Vice Chairman of the National Assembly in charge, who will then report to the Chairman of the National Assembly, the Standing Committee of the National Assembly, and the National Assembly Party Group for consideration and decision on handling the matter according to regulations, without waiting until the end of the supervision period.

At the same time, the National Assembly's Ethnic Council and Committees are directed to strengthen their work with central ministries and agencies to assess the implementation of recommendations following supervision, urge implementation, and organize re-supervision when necessary. The Secretary General of the National Assembly will preside over the coordination with the Ethnic Council and Committees of the National Assembly to assist the Standing Committee of the National Assembly in organizing the supervision of legal documents within its authority and proposing specific solutions to overcome difficulties and obstacles.
