Strengthening state management of labor leasing

BPO - Pursuant to Official Dispatch No. 1759/BNV-CTL&BHXH dated April 25, 2025 of the Ministry of Home Affairs, the Provincial People's Committee has just issued Official Dispatch No. 2131/UBND-NC on strengthening the effectiveness of state management of labor subleasing in the province.

In order to improve the effectiveness of state management of labor leasing, ensure the legitimate rights and interests of employees, promote labor leasing activities in accordance with regulations, transparency and efficiency, the Provincial People's Committee requests the Department of Home Affairs to carry out licensing and management of labor leasing activities in accordance with the provisions of the 2019 Labor Code and Decree No. 145/2020/ND-CP of the Government . Take the lead and coordinate with relevant departments and branches to promote the dissemination and propaganda of legal regulations on labor leasing activities, rights and obligations of employees and enterprises in leasing activities.

Department of Home Affairs   c. Preside over and coordinate with the Provincial Police , the Economic Zone Management Board , the Provincial Labor Federation , and the Provincial Social Insurance to strengthen inspection , supervision, and grasp the situation of labor leasing activities for leasing enterprises and labor leasing enterprises in the province , especially the list of jobs performed for labor leasing , promptly detect and handle violations in accordance with regulations .


Closely coordinate with commercial banks receiving deposits to regularly update the enterprise's deposit information.

Urge enterprises to make periodic reports according to legal regulations. Send notices of granting, re-granting, extending, and revoking labor leasing licenses, and at the same time summarize and periodically send reports on the labor leasing situation to the Ministry of Home Affairs and the Provincial People's Committee every 6 months and annually as prescribed. Regularly update information of enterprises granted, re-granted, extended, and revoked labor leasing licenses...

The Department of Science and Technology promotes the application of information technology in managing data on labor leasing activities, ensuring transparency and convenience for agencies, organizations and employees to look up. Encourage businesses to apply digital technology in labor management, contract monitoring and implementation of social insurance, health insurance and unemployment insurance obligations.

The provincial police will coordinate with the Department of Home Affairs to strengthen inspection and supervision of activities related to labor leasing, especially violations of the law such as labor abuse, exploitation or illegal activities; strictly handle violations according to the law.

The Economic Zone Management Board reviews and inspects the activities of enterprises leasing labor in industrial parks, border economic zones and industrial clusters in the province. Coordinates with the Department of Home Affairs and relevant agencies to guide and support enterprises in complying with legal regulations on labor leasing. Implements the provisions of the 2019 Labor Code, Decree No. 145/2020/ND-CP of the Government and related contents at the request of the Ministry of Home Affairs in Official Dispatch No. 1759/BNV-CTL&BHXH to enterprises in industrial parks, border economic zones and industrial clusters in the province.

The Provincial People's Committee requested the Provincial Labor Federation to strengthen the dissemination of laws on the rights and obligations of workers in labor leasing activities, especially in industrial parks, border economic zones and industrial clusters. Monitor the implementation of regulations on social insurance, health insurance, unemployment insurance and other regimes for leased workers. Coordinate with competent agencies to protect the legitimate rights and interests of workers, promptly detect and propose handling of violations.
