Creating legal conditions to promote key industries

(Chinhphu.vn) - Key industries play a very important role, being the driving force for the country's industrialization and modernization. However, there is currently no clear legal corridor to guide development. Therefore, the development of a Key Industry Law policy is very necessary.

Still lacks clear legal corridor

The role of key industries is specifically demonstrated as follows: Developing key industries is a decisive factor in national competitiveness, upgrading the level of industry, developing strategic technologies to create breakthroughs in transforming the economic development model; key industries create a very high spillover effect, promoting the effective development of other industries and economies.

Accordingly, the key industries regulated in the Law include: Metallurgy (Alloy steel, special steel for new generation machine manufacturing industry, other important metals); mechanical manufacturing: Agricultural machinery; automobiles; ships; construction equipment; energy equipment, electrical equipment; medical equipment; production of robots, integrated equipment for automatic operation, remote control; manufacturing industry for agriculture; chemicals: Basic chemicals, petrochemicals, pharmaceuticals, fertilizers; new materials; supporting industries.

At the meeting of the Policy Appraisal Council of the Law on Key Industries organized by the Ministry of Justice , Deputy Minister of Industry and Trade Truong Thanh Hoai said that key industries not only contribute greatly to GDP growth but also create spillover effects, promote the development of other industries and improve labor productivity in the whole society.

Identifying and developing key industries is one of the top priorities of the Government, in order to maximize comparative advantages and deeply integrate into the world economy. However, at present, there is no legal corridor clearly defining the focus for developing key industries in the industrialization process.

Current laws on incentives and development support for key industries are still fragmented, have low legal effect or have not been developed; there are limitations in implementing and monitoring policy implementation; the competitiveness of enterprises, especially enterprises in key industries, is still limited...

The development of policies of the Law on Key Industries aims to promote the development of key industries in accordance with the context of science, technology, innovation and achievements of the Fourth Industrial Revolution; towards building an independent, autonomous and self-reliant industry, contributing to rapid and sustainable economic development, becoming a developed country with high income in the socialist orientation;

At the same time, create a number of policy and legal breakthroughs to handle basic bottlenecks in the development of key industries in the direction from breadth to depth, from processing and assembly to research, design and production in Vietnam, with high knowledge and technology content and at the same time create breakthroughs in the modernization process in industry.

Promote the division of labor and decentralization through creating a legal basis to encourage the initiative and creativity of ministries and local branches in exploiting and promoting the best potential and advantages of the country, each region and locality; ensure an appropriate localization rate to meet the requirements and incentives on origin of goods in international trade; in accordance with bilateral and multilateral trade agreements and the requirements of major markets.

Accordingly, the Ministry of Industry and Trade proposed two groups of policies: Policies to encourage domestic manufacturing of key industrial products and policies to develop supporting industries.

It is necessary to build policies for the Law on Key Industries.

The representative of the Ministry of Science and Technology requested the drafting agency to analyze and clarify the basis for the proposal to establish a Key Industrial Development Fund in terms of its source of formation and operating mechanism. At the same time, it was pointed out that the contents proposed in the draft have many related and overlapping contents with the draft laws that the Ministry of Science and Technology has been and is developing, so it is necessary to review the entire legal system to ensure that the contents in the draft Law are consistent and do not overlap with the laws that have been issued and are expected to be issued soon.

Along with that, the members of the Appraisal Council recommended specific contents on: re-evaluating regulations that give rise to administrative procedures during implementation; reviewing the scope of the law to ensure no overlap with other laws; researching and evaluating to ensure the balance of incentive policies between domestic and foreign enterprises; adding criteria on investment incentives...

Deputy Minister of Justice Nguyen Thanh Tu agreed with the necessity of developing policies for the Law on Key Industries in the spirit of Resolution No. 29-NQ/TW, dated November 17, 2022, the 6th Conference of the 13th Party Central Committee on continuing to promote industrialization and modernization of the country to 2030, with a vision to 2045.

The Deputy Minister stated that the dossier is eligible to be submitted to the Government when it has fully received the opinions of the members of the Appraisal Council. Accordingly, the Deputy Minister requested the drafting agency to continue researching and perfecting the contents of the Law's scope of regulation, approach, and name; and review the contents of the Key Industrial Development Fund to ensure that it does not overlap with the Investment Support Fund.

At the same time, review and ensure that regulations do not overlap with the Law on Chemicals, the Law on Industrial Mobilization, the Law on Science, Technology and Innovation, the Law on Investment, and the Law on Bidding.

Regarding financial issues, the Deputy Minister pointed out that the draft has many contents that arise in terms of finance, so it is necessary to study and specifically regulate the arising resources; supplement the assessment of the contents on human resource development; make an overall assessment of administrative procedures; and review to ensure maximum promotion of decentralization and delegation of power.
