Tightly control, focus on cutting and simplifying administrative procedures, business conditions and implementing administrative procedures regardless of administrative boundaries.

Recently, implementing the direction of the Politburo and General Secretary To Lam, the Government, the Prime Minister, ministries, branches and localities have focused on cutting and simplifying administrative procedures (AP) and business investment conditions to facilitate production and business activities, contributing to promoting private economic development. Implementing the Resolutions of the Government, the Prime Minister approved the Plan to cut and simplify APs and business conditions under the management of 14 ministries and ministerial-level agencies; accordingly, it is expected to cut and simplify 2,051/4,888 APs, reaching 42%, cut 2,263/6,974 business conditions, reaching 32%; it is expected to amend and supplement 466 legal documents.

For localities, currently 25/34 provinces and centrally run cities have integrated and provided online public services with administrative procedures related to enterprises on the National Public Service Portal, reaching a rate of over 90%, of which 04 localities have reached 100%; 34/34 localities have published a list of administrative procedures regardless of administrative boundaries in the area.

However, according to reports from ministries, localities and data synthesis on the National Public Service Portal, there are currently a total of 668 specific administrative procedures of localities, in which some localities have increased the number of specific administrative procedures; the rate of administrative procedures related to enterprises provided online by ministries is generally still low compared to the target set in Resolution No. 66/NQ-CP dated March 26, 2025, in which 08 ministries achieved a rate of less than 50%; 03 localities have an integration rate and provision of online public services for administrative procedures related to enterprises reaching less than 70%; the list of administrative procedures not dependent on the administrative boundaries of the provinces mostly only reaches a rate of about 50% to 95% of the administrative procedures being provided, in which some localities only reach less than 10%. In addition, the business community continues to reflect that there are still some cumbersome administrative procedures, unnecessary business conditions, and prolonged time to enter the market....

Minimize business conditions and administrative procedures

1. To minimize business conditions and administrative procedures, the Prime Minister requests:

a) Ministers, Heads of ministerial-level agencies, Chairmen of People's Committees of provinces and centrally-run cities focus on directing, organizing synchronous, effective and drastic implementation of the following tasks:

(1) Strictly control and strictly implement the assessment of the impact of administrative procedures, review and evaluate business conditions in projects and draft legal documents; improve the effectiveness of consultation with affected subjects on regulations on administrative procedures and business conditions, especially administrative procedures and business conditions that affect the private economy and are directly related to enterprises and business households; research, receive, fully explain and publicly receive and explain comments on administrative procedures and business conditions.

(2) Direct the Ministry's Office, Legal Departments under ministries, ministerial-level agencies, People's Committee Offices, Public Administration Service Centers, and Departments of Justice under People's Committees of provinces and cities to focus on improving the quality of commenting and appraisal of regulations on administrative procedures in draft legal documents under their promulgation authority.

(3) Directing functional agencies and units to seriously, qualitatively, and on time implement approved plans to reduce and simplify administrative procedures and business conditions; at the same time, proactively reduce and simplify administrative procedures and business conditions in the process of developing and promulgating legal documents; in 2025, ensure maximum reduction of business conditions, reduce pre-inspection, increase post-inspection, reduce at least 30% of time for implementing administrative procedures, and at least 30% of costs of complying with administrative procedures related to production and business activities.

(4) Timely, fully and accurately announce and publicize administrative procedures on the National Database on Administrative Procedures so that cadres, civil servants, businesses and people know, implement and monitor, supervise and evaluate the implementation process.

(5) Monitor, supervise and evaluate the implementation of administrative procedures after promulgation; promptly detect and amend regulations and administrative procedures that are no longer suitable and hinder the development of enterprises and business households.

b) Minister of Justice and Minister, Head of the Government Office

The Minister of Justice focuses on improving the quality of appraisal of regulations on administrative procedures in proposals, projects, and draft legal documents; the Minister and Head of the Government Office organizes appraisal and gives independent opinions on regulations on administrative procedures in proposals, projects, and draft legal documents submitted by ministries, branches, and localities to the Government and the Prime Minister; ensuring that only newly issued and maintained administrative procedures that are truly necessary, legal, and reasonable, with the lowest compliance costs.

c) Minister of Finance

Urgently research and reform licensing procedures in the direction of reducing and simplifying investment registration certificates and implementing them online, shortening the time to enter the market; loosening barriers on investment restriction lists; coordinating with ministries, branches and localities to immediately remove difficulties and obstacles that businesses encounter due to administrative procedures regulations and implementation by state agencies, especially administrative procedures related to investment, market entry...; report to the Prime Minister on issues beyond authority, to be completed by December 2025.

Implementing administrative procedures regardless of administrative boundaries and providing full online public services

2. To implement administrative procedures regardless of administrative boundaries and provide full online public services, the Prime Minister requests:

a) Ministers, Heads of ministerial-level agencies, Chairmen of People's Committees of provinces and centrally-run cities direct the review and implementation of online public service provision for 100% of administrative procedures related to enterprises, ensuring smoothness, continuity, efficiency, transparency, minimizing paperwork, to be completed in 2025.

b) Minister, Head of ministerial-level agency

(1) Focus on completing the construction of specialized databases and putting them into operation, connecting with national databases (such as land, civil status, construction...) to meet the data requirements of "correct, sufficient, clean, live, unified, shared", connecting and sharing complete data in real time with the National Public Service Portal, the Information System for handling administrative procedures at the ministerial and provincial levels to serve the reduction and simplification of administrative procedures and the deployment of online public services based on data.

(2) Speed ​​up the progress of completing the restructuring of processes and providing online public services in accordance with the goals and requirements in Plan No. 02-KH/BCĐTW dated June 19, 2025 of the Central Steering Committee on science and technology development, innovation and digital transformation, and guidance of the Government Office, especially administrative procedures for enterprises and administrative procedures under the jurisdiction of provincial and commune levels.

c) Chairman of the People's Committee of the province or centrally-run city

(1) Timely and fully publicize the list and organize the implementation of administrative procedures regardless of administrative boundaries within the province, helping people conveniently choose to submit administrative procedures appropriate to their place of residence, living, studying, and working. Organize the implementation of guidance, reception, and settlement of administrative procedures for people and businesses, ensuring efficiency and smoothness, avoiding local congestion, and completing the goal of 100% of administrative procedures being implemented regardless of administrative boundaries within the province in 2025.

(2) Complete the transfer of data from the Information Systems of the provinces before the merger to the unified, shared Information System after the merger to serve the settlement of administrative procedures for people and businesses; review and arrange sufficient funding and human resources, ensure conditions for equipment and network infrastructure at the commune level in accordance with the scale and number of actual transactions, in which, in the immediate future, communes with an average number of transactions of less than 20 records/day are not required to be equipped with number machines and display screens, ensuring efficiency, avoiding waste, creating a premise for synchronous and effective operation of the Public Administration Service Center, to be completed before October 15, 2025.
