Aircraft procedures are "untied": registration time is shortened to only 5 days

From November 1, 2025, the deregistration of nationality and export of aircraft will be carried out more quickly thanks to Decree 246/2025/ND-CP. The new regulation gives more power to the person designated in the IDERA document, and at the same time reduces the time to process the application to 5 days.

The Government has just issued Decree No. 246/2025/ND-CP, effective from November 1, 2025. This Decree amends and supplements a number of articles of Decree No. 68/2015/ND-CP, regulating nationality registration and registration of rights to aircraft.

The Government's amendments and supplements this time were issued at the request of the Minister of Construction .

The most prominent point in Decree 246/2025/ND-CP is the addition and clarification of regulations related to the deregistration of aircraft nationality at the request of the person designated in the IDERA document (Irrevocable Deregistration and Export Request Authorisation).

According to the new regulations, the cancellation of aircraft nationality registration is carried out upon the request of the person designated in the IDERA document. In particular, if the IDERA document has been registered as prescribed, only the person designated in the IDERA document has the right to request the cancellation of aircraft nationality registration.

Cases of deregistration at the request of the person designated in the IDERA document or the aircraft owner/person requesting aircraft registration will be carried out by submitting a set of documents directly, via the postal system or via the online public service system to the Civil Aviation Authority of Vietnam. The requester shall be responsible for the accuracy and truthfulness of the information recorded in the documents.

Shorten the time and issue export flight qualification certificates

Decree 246/2025/ND-CP clearly stipulates the time limit for processing dossiers:

Within five working days from the date of receipt of a complete and valid dossier, the Civil Aviation Authority of Vietnam shall issue a Certificate of Deregistration of Vietnamese Aircraft Nationality and a Certificate of Airworthiness for Export according to Form No. 06a in the case of Deregistration of Aircraft Nationality at the request of the person designated in the IDERA document.

At the same time, the Civil Aviation Authority of Vietnam will revoke the Certificate of Vietnamese nationality of aircraft.

In case the application is incomplete, the Civil Aviation Authority of Vietnam will issue a document instructing the applicant to complete the application within 2 working days from the date of receipt of the application.

The application for deregistration of aircraft nationality and certification of airworthiness for export under IDERA must include the Declaration Form No. 02a, a copy of the legal status certificate, and the written consent to deregistration and export of the aircraft of the persons with international interests registered with a higher priority order.

If the person designated at IDERA is the aircraft guarantee recipient, the application also requires documentation proving that written notice has been given to the registered international interest holders, the aircraft owner, and the applicant for registration of aircraft nationality at least 10 working days before the date of submission of the application.

Adjusting the management agency in some regulations

The Decree also makes important administrative adjustments:

This Decree supplements Form No. 02a, Form No. 06a and Form No. 15 to the Appendix.

The phrase " Ministry of Transport " is replaced by the phrase "Ministry of Construction" in Clause 1 and Clause 2, Article 30 of Decree 68/2015/ND-CP. The same replacement is also applied in Forms No. 04, No. 05, No. 06, No. 07, No. 08, No. 09, No. 10 in the Appendix attached to Decree 68/2015/ND-CP.

Ministers, Heads of ministerial-level agencies, Government agencies and Chairmen of People's Committees of provinces and centrally run cities are responsible for implementing this Decree. Dossier submitted before November 1, 2025 will still be processed according to the new regulations.
