Proposal to maintain death penalty for embezzlement and bribery
Continuing the 9th Session, on the morning of May 27, the National Assembly discussed in the hall the draft Law amending and supplementing a number of articles of the Penal Code.
Eight crimes expected to be exempted from the death penalty include: Crime of activities aimed at overthrowing the people's government; Crime of sabotaging the State's material and technical facilities; Crime of producing and trading in counterfeit medicines and preventive medicines; Crime of undermining peace and waging aggressive wars; Crime of espionage; Crime of illegal transportation of narcotics; Crime of embezzlement of property; Crime of accepting bribes.

Expressing his opinion, delegate Nguyen Thanh Sang (Ho Chi Minh City Delegation) suggested considering abolishing the death penalty for embezzlement and bribery, especially in the context that the Party and State are fighting very strongly against corruption.
Mr. Sang said that the crimes of embezzlement and bribery are currently very complicated, not only in the public sector but also invading the private sector.
Citing evidence from the AVG case (bribe amounted to 3 million USD) and the Rescue Flight case (bribe amounted to hundreds of billions of VND), the delegate said that both cases had a common feature: after being sentenced to death, the defendant had to remedy all the consequences.
"People are watching and weighing whether the court will sentence them to death. People know that if they don't fix it, they will die. So, clearly the death penalty is effective. So if the death penalty is abolished, will the effectiveness of asset recovery increase?" - Mr. Sang raised the question.
Concerns that Vietnam will become a transit point for drugs abroad if the death penalty is abolished
Regarding the crime of illegal drug trafficking, Mr. Sang also proposed not to abolish the death penalty. Giving reasons, the National Assembly delegate said that for the illegal drug trafficking to be successful, the transporter plays the most important role as an accomplice.
Although the highest penalty has been prescribed for this type of crime, the amount of buying, selling and transporting is increasing, with cases of seizures of hundreds of kilograms and tons of drugs.
"Some say the transport was instigated. But I affirm that the person who transported hundreds of heroin cakes was a professional transporter, there is no reason to be lenient with this person. I am afraid that if we abolish the death penalty for this crime, Vietnam will become an international transit point," said Mr. Sang.
Sharing the same view, National Assembly delegate Nguyen Tam Hung (Ba Ria - Vung Tau delegation) also recommended that the drafting agency carefully consider and review the abolition of the death penalty for drug trafficking crimes.

He said that for particularly serious drug crimes such as production, storage, transportation, trading... in large quantities with transnational elements. The indirect but serious consequences affect national security and people's health.
"The death penalty can be chosen for particularly serious cases, organized, professional, repeat offenders or ringleaders. At the same time, there should be appropriate mitigation policies for cases that honestly confess and remedy the consequences" - the delegate proposed.
