Regarding the drafting of the E-commerce Law, the Ministry of Industry and Trade has recently developed five sets of documents related to the proposal for the E-commerce Law, including: the draft law dossier, the impact assessment report, the summary report on the implementation of current laws, and the policy proposal report.
These documents have been publicly posted on the Government's electronic portal and the Ministry of Industry and Trade's electronic portal since January 17, 2025, to solicit broad feedback from organizations and individuals as prescribed.
Furthermore, based on an assessment of practical implementation and the identification of necessary additions and improvements for future e-commerce policy planning, the Ministry of Industry and Trade has identified five major policy groups: Supplementing and unifying concepts according to current legal regulations; regulating e-commerce activities, participating entities, and related rights and obligations, with the goal of ensuring that no e-commerce operating models or participating entities are overlooked; ensuring transparency in authority and clarity in the limits of responsibility of state management agencies at all levels; and defining the responsibilities of e-commerce support service providers.
Regulations on electronic contract authentication services in commerce aim to ensure fair treatment for all types of reliable service providers; and to quickly detect and handle legal violations related to electronic contracts. Regulations on the development of e-commerce aim to institutionalize the views, policies, and guidelines of the Party and Government on promoting e-commerce development; to promote green and sustainable e-commerce development, contributing to effective economic development, creating value for the community, contributing to building a just society, and minimizing negative impacts on the environment.
The Ministry of Industry and Trade has also sought opinions from ministries, sectors, and provincial and city People's Committees regarding the review of the implementation of e-commerce laws, a comprehensive assessment of the policy impacts of the E-commerce Law, and a review of international laws and international commitments related to the e-commerce sector.
