(MPI) - The Minister of Planning and Investment has just issued Decision 413/QD-BKHĐT dated April 8, 2024 on the establishment of the Drafting Committee and Editorial Team of the Decree replacing Decree No. 01/2021/ND-CP dated January 4, 2021 of the Government on business registration, in which Deputy Minister of Planning and Investment Tran Duy Dong is assigned as Head of the Drafting Committee.

Members of the Drafting Committee are representatives of ministries, branches and localities including: Government Office , Ministry of Public Security, Ministry of Justice, Ministry of Finance, Ministry of Science and Technology, Ministry of Labor - Invalids and Social Affairs, Social Insurance, State Securities Commission, Vietnam Federation of Commerce and Industry (VCCI), Hanoi Department of Planning and Investment, Ho Chi Minh City Department of Planning and Investment and representatives of relevant units under the Ministry of Planning and Investment.
The Drafting Committee operates according to the principles of collective discussion; Ensuring transparency, objectivity and scientific nature; Promoting the personal responsibility of the Head of the Drafting Committee and members of the Drafting Committee.
The Drafting Committee is responsible for organizing the drafting and is responsible for the quality and progress of the drafting of the draft Decree replacing Decree No. 01/2021/ND-CP dated January 4, 2021 of the Government on business registration. Review and approve the detailed outline of the draft Decree; Discuss the content of the draft document, submission, explanation, and receive comments from agencies, organizations, and individuals.
Ensure that the provisions of the draft are consistent with the Party's policies and guidelines, ensure the constitutionality, legality, and consistency of the draft with the legal system; ensure the feasibility of the document; meet the requirements of innovation, application of information technology, and digitalization in implementing the one-stop, one-stop mechanism in handling administrative procedures.
The Head of the Drafting Committee has the tasks of directing the Editorial Team to draft and revise the draft Decree; Organizing meetings and other activities of the Drafting Committee.
Members of the Drafting Committee are responsible for fully attending all meetings of the Drafting Committee, and are responsible for the quality, constitutionality, legality, consistency, and feasibility of the assigned contents in the draft document and the progress of drafting the document; in case they cannot attend for objective reasons, they must provide written comments.
The task of the Editorial Team is to assist the Drafting Board in completing the draft Decree and documents according to regulations; to implement the Drafting Board's instructions on receiving and revising the draft Decree; to be responsible for the quality and progress of drafting the draft Decree and documents; the Editorial Team Leader is responsible for reporting to the Editorial Board Leader on the status of drafting the draft Decree; Editorial Team members are responsible for fully participating in the activities of the Editorial Team and are subject to the assignment of the Editorial Team Leader.
On January 4, 2021, the Government issued Decree 01/2021/ND-CP, consisting of 9 chapters and 101 articles, detailing the dossiers, procedures, and formalities for business registration and household business registration; regulations on the Business Registration Authority and state management of business registration and household business registration.
The coordination of procedures for registering the establishment of enterprises, branches, representative offices, declaring the use of labor, granting codes for units participating in social insurance, and registering the use of invoices of enterprises shall comply with the provisions of the Government's Decree on coordination and linkage of procedures for registering the establishment of enterprises, branches, representative offices, declaring the use of labor, granting codes for units participating in social insurance, and registering the use of invoices of enterprises.
In order to continue to specify the reforms, innovations, overcome shortcomings, and handle difficulties in the past time, the Ministry of Planning and Investment was assigned to preside over and coordinate with ministries, branches, and localities to develop a Decree to replace Decree No. 01/2021/ND-CP dated January 4, 2021 of the Government on business registration. In particular, it continues to clearly and specifically stipulate the dossiers, order, and procedures for business registration; modernize and strongly digitalize business registration through upgrading and perfecting regulations on online business registration, contributing to further improving the transparency of the business environment./.
